⚖️ IMPORTANT JUDGMENT | 2026 P Cr. LJ 1334

📌 Geo-Fencing & Call Data Record (CDR)

Under Section 94 Cr.P.C., an accused may seek production of Geo-Fencing/CDR to test the presence and credibility of prosecution witnesses.

There is no bar on summoning such evidence during prosecution evidence. The Court may order production at any stage of the trial.

Under Article 164, Qanun-e-Shahadat Order, 1984, evidence obtained through modern devices, including CDR, may be allowed subject to the facts and circumstances of the case.

⚖️ Key Principle: Courts must exercise their discretion cautiously and judiciously to ensure a fair and just trial.

⚖️ MUST READ JUDGMENT | PLD 2026 LAHORE 635 🚨

📌 کیا سول کورٹ آپ کا CNIC ضبط، منسوخ یا بلاک کر سکتی ہے؟

لاہور ہائی کورٹ کے اہم فیصلے کے مطابق:

🔹 NADRA کی جانب سے جاری کردہ CNIC منقولہ جائیداد (Movable Property) نہیں ہے۔

🔹 لہٰذا سول عدالتیں اسے ضبط (Attach)، اپنے قبضے میں لے، منسوخ (Cancel) یا بلاک (Block) نہیں کر سکتیں بطور coercive measure۔

🔹 CNIC کو صرف متعلقہ قانونی اتھارٹی ہی National Database and Registration Authority Ordinance, 2000 کے Section 18 میں مقرر کردہ طریقہ کار اور حالات کے مطابق منسوخ، ضبط یا impound کر سکتی ہے۔

⚠️ یہ فیصلہ شہریوں کے بنیادی قانونی حقوق کے حوالے سے نہایت اہم ہے۔

⚖️ MUSLIM MARRIAGE — REGISTRATION IS A LEGAL REQUIREMENT

Under Muslim family law, every marriage solemnized under Muslim law is required to be registered with the Nikah Registrar.

📌 Why is registration important?

A duly registered Nikahnama serves as an official public record and carries important probative value before the Court. Failure to register a marriage may create serious legal difficulties and can weaken the legal foundation of a claim relating to the marital relationship.

🔹 Proper registration helps establish the marriage through an official documentary record.

⚖️ اہم عدالتی فیصلہ | Bail Refused

🚍 بغیر PSV لائسنس کے بس چلانا غیر قانونی قرار — Qatl-bis-Sabab کا اطلاق

لاہور ہائی کورٹ نے قرار دیا کہ اگر کوئی شخص HTV لائسنس رکھتا ہو لیکن PSV لائسنس/اینڈورسمنٹ کے بغیر پبلک سروس گاڑی (بس، کوسٹر، وین وغیرہ) چلاتا ہے اور اس کی رش ڈرائیونگ یا غفلت کے نتیجے میں کسی شخص کی موت واقع ہو جائے تو معاملہ Qatl-bis-Sabab کے زمرے میں آ سکتا ہے اور دفعہ 322 PPC کا اطلاق ہو سکتا ہے۔

📌 عدالت کے مطابق صرف HTV لائسنس کا ہونا بس چلانے کے لیے کافی نہیں، اگر قانون کے تحت PSV لائسنس لازمی ہو۔

⚠️ غیر قانونی طور پر گاڑی چلانا صرف ڈرائیور کی اپنی جان نہیں بلکہ مسافروں اور عام شہریوں کی زندگیوں کو بھی خطرے میں ڈالتا ہے۔
