The Supreme Court, in its order penned by Mr. Justice Mansoor Ali Shah, has declared that the right to maintenance of a wife flows from the solemnization of a valid nikah. This right is neither a quid pro quo for physical obedience nor linked with consummation or physical availability for conjugal relations.

The court has used the term "feminist jurisprudence" for the first time and denounced patriarchal notions surrounding the concept of marriage in society.
