Chief Justice of Pakistan Mr. Justice Jawwad S. Khawaja authored a classic Judgment on the issue of "URDU LANGUAGE". A must read for all patriots!!

"These two Constitution Petitions filed under Article 184(3) of the Constitution of Pakistan have raised an issue which has a direct nexus with the life of every common man and woman living in Pakistan. Mr. Muhammad Kowkab Iqbal,
Petitioner in Constitution Petition No. 56 of 2003 and Syed Mahmood Akhtar Naqvi, Petitioner in Constitution Petition No. 112 of 2012, have prayed for the implementation of Article 251 of the Constitution, which commands the state to adopt Urdu as the official language of the country and also stipulates that steps may be taken by the provinces for the promotion of provincial languages. Since both Constitution Petitions have sought similar relief, the same were heard together.

2. As the matter revolves around Article 251 of the Constitution, for ease of reference, it is reproduced as under: “National Language 251. (1) The National language of Pakistan is Urdu, and arrangements shall be made for its being used for official and other purposes within fifteen years from the commencing day.
(2) Subject to clause (1), the English language may be used for official purposes until arrangements are made for its replacement by Urdu.
(3) Without prejudice to the status of the National language, a Provincial
Assembly may by law prescribe measures for the teaching, promotion and use of a provincial language in addition to the national language.”........

On 7th October 2015, Supreme Court of pakistan passed the following Judgment in Malik Mumtaz Qadri case (murder case of Governor Punjab).:

"Almighty Allah has ordained
in the Holy Qur’an that upon receipt of a news or information the
men of faith ought to ascertain correctness of such news or
information before they may act upon the same and that harm
may be avoided if such news or information is got investigated in
the first place. The following verses of the Holy Qur’an are relevant
in this regard:
Surah Al-Hujurat: verse 6

“O you who have faith!
If a profligate [person] should bring you some news, verify it, lest
you should visit [harm] on some people out of ignorance, and then
become regretful for what you have done.”
Surah An-Nisa: verse 94

“O you who have faith!
When you issue forth in the way of Allah, try to ascertain: do not
say to someone who offers you peace, ‘you are not a believer’,
seeking the transitory wares of the life of this world. Yet with Allah
are plenteous gains. You too were such earlier, but Allah did you a
favour. Therefore, do ascertain. Allah is indeed well aware of what
you do.”
Surah An-Nisa: verse 83

“When a report of safety or alarm comes to them, they immediately
broadcast it: but had they referred it to the Apostle or to those
vested with authority among them, those of them who investigate
would have ascertained it. And were it not for Allah’s grace upon
you and His mercy, you would have surely followed Satan, [all]
except a few.”

In the following paragraphs of this judgment it shall be highlighted
as to how the accused person in this case had acted on the basis of nothing but hearsay without getting his information ascertained,
verified or investigated and, as Almighty Allah has warned, he has
brought harm not only to another person but also to himself.
Verily, such are the consequences when Almighty Allah’s warnings or commands are not heeded to......."

On 26th of February, 2014, THE SUPREME COURT OF PAKISTAN has passed the following clarification Order:

"Through this petition, petitioner has sought
clarification of the Order passed earlier...:

“……………….. we hereby until further orders restrain the
Government/Revenue Department from mutation, allotment,
transfer and or conversion of any state land and or keeping any
transaction or entry in the record of rights in this regard in revenue
record of Sindh or till the entire revenue record in Sindh is
reconstructed. The conversion of lease for 30 years or of any term
upto 99 years shall also be stopped immediately as by this mode
the state land isbeing sold out at the throwaway price without
participation of public at large, which the law does not permit. Any
further conversion or mutation of state land in the record of rights
from today onwards would be deemed nullity and would expose
the Deputy Commissioner/DCO of the relevant districts/dehs
besides others to contempt proceedings.”

However, it is expedient to clarify that as far as the above
restraint order is concerned, it shall be applicable only to the extent of the State land only. As far as the private property which is
required for the purposes of utilization by the State itself etc is
concerned the revenue authorities shall be free to enter the
transaction/mutation etc in the record of rights as usual. However,
for further clarification he would approach the department for
passing the appropriate orders......"

CONGRATULATIONS,
Our Constitution Petition against HESCO (Hyderabad Electric Supply Company) was allowed by Sindh High Court, whereby HESCO has been ordered to make payments within 10 days to our clients (Power Producer) for the electricity supplied and NEPRA (National Electric Power Regulatory Authority) has been ordered to decide the dispute between our client and HESCO within 60 days.
