سپریم کورٹ نے 71 سال قبل انتقال ہبہ کے ذریعے جائیداد سے محروم کی جانیوالی بہنوں اور والدہ کو وراثتی جائیداد میں سے حصہ دینے کا حکم دے دیا۔ماتحت عدالتوں کے فیصلے اور انتقال ہبہ کالعدم قرار .
وراثت مردوں کی مہربانی نہیں بلکہ شرعی و قانونی حق ہے، خواتین کو محروم کرنے کے لئے جعلی ہبہ، فراڈ اور خاندانی دباؤ ہرگز قبول نہیں، 1955ء میں والد کے انتقال کے بعد دونوں بھائیوں نے وراثتی جائیداد اپنے نام منتقل کرا لی اور زبانی ہبہ کو بنیاد بنا کر والدہ اور بہنوں کو جائیداد سے محروم کر دیا تھا۔
سپریم کورٹ کے جسٹس شاہد بلال حسن کی سربراہی میں دورکنی بنچ نے نور محمد کی اپیل پر 14 صفحات پر مشتمل فیصلہ جاری کیا، عدالت نے واضح کیا کہ وراثت خاندان کے مرد افراد کی مہربانی یا صوابدید نہیں بلکہ ہر وارث کا شرعی اور قانونی حق ہے، جو مورث کے انتقال کے ساتھ ہی خود بخود منتقل ہو جاتا ہے۔
فیصلے میں قرار دیا کہ خواتین کو وراثت سے محروم کرنے کیلئے جعلی ہبہ، جعلی انتقال، فراڈ، خاندانی دباؤ یا رسم و رواج کو ہرگز برداشت نہیں کیا جا سکتا، عدالتوں پر لازم ہے کہ خواتین کو وراثت سے محروم کرنے والی ہر ٹرانزیکشن اور معاہدے کا انتہائی احتیاط سے جائزہ لیں تاکہ کسی بھی خاتون کے بنیادی حق کو سلب نہ ہونے دیا جائے۔
جسٹس شاہد بلال حسن نے فیصلے میں لکھا کہ خواتین کے وراثتی حصے علامتی یا اختیاری نہیں بلکہ لازمی حقوق ہیں، خواتین کو خاندانی عزت، روایت یا سماجی دباؤ کے نام پر وراثت سے محروم نہیں کیا جا سکتا۔
فیصلے میں کہا گیا کہ ریاست، عدالتیں اور ریونیو حکام خواتین کے وراثتی حقوق کے تحفظ کے ذمہ دار ہیں، جبکہ خواتین کو صرف کاغذی نہیں بلکہ عملی طور پر بھی ان کا حق ملنا چاہیے، عدالت نے مزید قرار دیا کہ قانون کا جھکاؤ خواتین کے وراثتی حقوق کے تحفظ کی طرف ہونا چاہیے، نہ کہ ان کے خاتمے کی طرف۔
عدالتی فیصلے کے مطابق ریکارڈ سے ثابت ہوا کہ 1955ء میں والد کے انتقال کے بعد دونوں بھائیوں نے وراثتی جائیداد اپنے نام منتقل کرا لی اور زبانی ہبہ کو بنیاد بنا کر والدہ اور بہنوں کو جائیداد سے محروم کر دیا، درخواست گزاروں نے مؤقف اختیار کیا کہ یہ زبانی ہبہ جعلسازی کے ذریعے منظور کرایا گیا سپریم کورٹ نے قرار دیا کہ زبانی ہبہ ثابت کرنے کا بوجھ اس فریق پر ہوتا ہے جو اس سے فائدہ حاصل کر رہا ہو۔
عدالت نے کہا کہ ٹرائل کورٹ نے بارِ ثبوت کا درست جائزہ لینے کے بجائے خود ہبہ کو ہی ثبوت تسلیم کر لیا، جو قانون کے سراسر منافی تھا، عدالت کے مطابق ٹرائل کورٹ، اپیلیٹ کورٹ اور ہائی کورٹ کے فیصلے حقائق اور قانون دونوں کے برعکس تھے۔
فیصلے میں مزید کہا گیا کہ اگرچہ ہائی کورٹ نے یہ مؤقف اختیار کیا تھا کہ زبانی ہبہ کو کئی دہائیوں تک چیلنج نہیں کیا گیا، تاہم تاخیر کے باوجود ہبہ ثابت کرنا فائدہ اٹھانے والوں کی ذمہ داری تھی، ریکارڈ سے یہ بھی ظاہر ہوا کہ معاہدے کے بعد کئی برس تک والدہ اور بہنوں کو زمین کی آمدن میں حصہ ملتا رہا، جو اس بات کا ثبوت ہے کہ انہیں مبینہ ہبہ سے لاعلم رکھا گیا تھا۔
سپریم کورٹ نے تاخیر سے دعویٰ دائر کرنے کی بنیاد بھی مسترد کرتے ہوئے درخواست گزاروں کی اپیل منظور کر لی اور تمام ماتحت عدالتوں کے فیصلے کالعدم قرار دیتے ہوئے متعلقہ ریونیو حکام کو وراثتی ریکارڈ قانون کے مطابق درست کرنے کی ہدایت جاری کر دی۔
The right of inheritance is not a bounty to be bestowed at the pleasure of male family members nor a concession dependent upon custom, convenience or familial goodwill. It is a vested Shari and legal right which devolves upon the heirs immediately upon the death of the predecessor-in-interest and cannot be defeated through private arrangements, social pressures, dubious revenue entries or procedural stratagems. This Court has repeatedly emphasized that the law of inheritance occupies a unique position in Islamic jurisprudence because it embodies the Divine scheme of distribution of wealth and seeks to ensure economic justice within the family and society at large. The experience of the courts, however, demonstrates that women continue to be deprived of their lawful inheritance through a variety of devices, including fabricated gifts, manipulated revenue entries, fraudulent relinquishments, coercive family arrangements and prolonged litigation designed to exhaust those asserting their rights.
The Constitution of the Islamic Republic of Pakistan does not countenance the deprivation of women from their lawful inheritance. Article 2A incorporates the principles of democracy, freedom, equality, tolerance and social justice as enunciated by Islam, while Article 25 guarantees equality before law and equal protection of law. Articles 23 and 24 recognize and protect the right to acquire, hold and enjoy property and prohibit deprivation thereof save in accordance with law. Article 35 further obligates the State to protect the family, the mother and the child. Article 227 further mandates that all laws shall be brought in conformity with the Injunctions of Islam. These constitutional guarantees, when read in conjunction with the Islamic injunctions relating to inheritance, leave no room for ambiguity. The State is not a passive spectator where women are deprived of property lawfully devolving upon them through succession. The constitutional guarantee of equality before law becomes illusory if women are denied ownership of property that has vested in them by operation of law. Likewise, the constitutional protection of property rights is rendered meaningless if inheritance rights can be defeated through coercion, fraud, social pressure, manipulated revenue entries, dubious family arrangements or prolonged litigation. The Constitution, therefore, imposes a positive obligation upon all organs of the State, including the courts and revenue authorities, to ensure that female heirs are able to obtain, retain and enjoy their lawful inheritance in a practical and effective manner and not merely as a matter of abstract legal entitlement. Any custom, practice, arrangement or device which has the effect of excluding a female heir from her lawful share not only offends the injunctions of Islam but is also inconsistent with the constitutional commitment to equality, dignity, social justice and protection of property rights.
The responsibility, however, does not rest upon the State alone. Families, Community leaders, Islamic Scholars and Orators, members of the legal profession, revenue authorities and civil society all share a collective obligation to ensure that the rights conferred by Almighty Allah are neither diluted nor defeated. A society that celebrates the virtues of justice while tolerating the deprivation of women from their lawful inheritance suffers from a contradiction that cannot be reconciled with either constitutional values or Islamic principles. The true measure of a legal system lies not in the rights it proclaims but in the rights it protects. Courts must, therefore,remain vigilant to ensure that inheritance laws are not circumvented through artificial devices and that women receive, in substance and not merely in theory, the shares to which they are lawfully entitled.
We accordingly observe that all courts and revenue authorities dealing with inheritance disputes must remain mindful that the law leans in favour of protecting, rather than defeating, the inheritance rights of women, the vulnerable segment of the society, and any transaction having the effect of excluding a female heir from succession must be examined with the utmost care, caution and judicial scrutiny.
