Order I CPC – Parties to a Suit
Order I of the Code of Civil Procedure, 1908 lays down the framework for determining who should be included as parties in a civil suit.
Key points:
• Distinction between necessary and proper parties
• Rules for joinder, misjoinder, and non-joinder of parties
• Court's power to add, delete, or substitute parties during proceedings
• A suit is not dismissed merely for misjoinder or non-joinder (Rule 9)
A foundational provision for law students and practitioners dealing with civil litigation in Pakistan.
