When a mother passes away, custody doesn't automatically transfer to the father.

Under the Hanafi principles Pakistani courts follow, the maternal grandmother holds the right of custody until the child turns 7, ahead of the father, because the law prioritizes keeping a young child in familiar female care. This right isn't absolute though. Courts can and do award custody to the father where the child's welfare genuinely requires it, as seen in real Lahore High Court rulings.

Once a child passes the age of Hizanat, custody typically shifts to the father as the natural guardian.

Save this before anyone tells her khula means she can never go back.

Khula is not the same as three talaqs. It only counts as one. And after one talaq, a wife can marry the same husband again, no in between marriage, no waiting on anyone else. Just a new nikah. Pakistan's Federal Shariat Court has said this clearly too.

Khula is not the same as three talaqs. It only counts as one. And after one talaq, a wife can marry the same husband again without halala. The same principle has been held by the Honourable Federal Shariat Court of Pakistan as well.

If a mother remarries someone who isn't closely related to the child, courts mayreview the custody arrangement but the outcome depends entirely on the child's welfare, not the remarriage itself. In many cases, mothers retain custody after remarriage where it's in the child's best interest.
