: Federal Shariat Court Restores Section 325 PPC

In a significant legal development, the Federal Shariat Court (FSC) has reinstated Section 325 of the Pakistan Penal Code (PPC), effectively restoring punishment for attempted su***de in Pakistan.

The court declared the Criminal Laws (Amendment) Act 2022, which had decriminalized attempted su***de, to be inconsistent with Islamic injunctions, thereby striking down the amendment.

The verdict was announced by a three-member bench comprising Justice Iqbal Hameedur Rahman, Justice Dr. Syed Muhammad Anwer, and Justice Ameer Muhammad Khan.

Previously, Section 325 stated that a person attempting su***de could face simple imprisonment of up to one year, a fine, or both. The 2022 amendment had removed this provision after approval by parliament.

According to the petition presented before the court, the argument was that protecting human life is a state responsibility, and the law serves as a deterrent.

1. عدالت نے کہا کہ CNIC بلاک کرنا عملداری کا درست طریقہ نہیں، کیونکہ یہ ضابطہِ دیوانی (CPC) کی دفعہ 51 کی شق (e) کے دائرے میں نہیں آتا۔
2. یہ شق عام اختیار تو دیتی ہے، مگر اسے اتنا وسیع نہیں کیا جا سکتا کہ دیوالیہ کی معمولی زندگی گزارنے کی ضروریات ہی ختم کر دی جائیں۔
3. CNIC عیش و آرام یا محض قانونی دستاویز نہیں، بلکہ آج کے دور میں معمول کی زندگی گزارنے کے لیے بنیادی ضرورت ہے۔
4. صوبہ خیبرپختونخوا میں CPC میں ایک ترمیم کر کے CNIC بلاک کرنے کی صراحتاً گنجائش پیدا کی گئی ہے، مگر یہ ترمیم سندھ میں نافذ العمل نہیں۔
5. حقیقت یہ ہے کہ پشاور ہائی کورٹ کو واضح طور پر یہ اختیار شامل کرنا پڑا، اس سے ثابت ہوتا ہے کہ عام دفعات کے تحت یہ اختیار موجود نہیں۔

فیصلہ:
سپریم کورٹ نے سندھ ہائی کورٹ کا فیصلہ کالعدم قرار دیتے ہوئے اپیل منظور کر لی اور CNIC بلاک کرنے کا حکم منسوخ کر دیا۔

There is no denial of the fact that last seen evidence itself is not considered sufficient for establishing the guilt but if, the chain of the facts is such that no reasonable inference can be drawn except that the accused had committed the offence, after the victim has been last seen in his company then in absence of reasonable explanation from the accused, such evidence can be relied upon.

On going through the Art.40 of Qanun-e-Shahadat Order one thing is very obvious that information received from the accused is admissible and can be used against him, if something incriminating is recovered in pursuance of his information. To be admissible and used against the accused, the recovery must be based on a statement made by the accused, while in police custody and this statement must lead to the discovery of a fact not previously known to the police. If the accused has exclusive knowledge of the body’s location, the recovery is considered as strong piece of circumstantial evidence.

The fundamental principle of universal application in cases dependent on circumstantial evidence is that in order to justify the inference of guilt, the incriminating fact must be incompatible with the innocence of the accused or the guilt of any other person and incapable of explanation upon any other reasonable hypothesis than that of his guilt.
