A SIMPLE ATTEMPT TO REMOVE AMBIGUITY:::::::::: (1) ACT: Act means a law passed by the Parliament through adopting proper legislative procedure/bossiness, after obtaining approval and consent of the Parliamentary Committee, Lower House and Upper House of the Parliament, for example,,, Ant-Terrorism Act, (2) ORDINANCE: A law made by the President/Competent Authority in absence of Legislature/Parliament or in acute emergency state for a specific period which later-on expires or the Parliament gives consent which becomes a permanent law. It has life of 120 days and It is extendable one time by the President and Parliament may reject, set-aside or may give consent to it, Parliament may convert it into act by adopting/passing in the Parliament (3) CODE: A set of secondary laws (other then Constitution) especially made and uniformed in a single code/bare aiming at effective applicability and regulating the procedure of Forums/courts and specified outcomes/punishment for example, Pakistan Penal Code and Crl Procedure Code. (4) STATUTE: A Comprehensive Term used for different laws including Act, Ordinance and Orders. In other words, laws having protection of the Constitution. (5) MANUAL: It is neither a legal term nor a kind of law but it is a general term used for a compendium/compilation/ins-cyclopedia of laws of specific filed/profession or department, containing all the relevant laws and rules. For example, Manual of Jail Laws, Manual of Military Laws. (6) ARTICLE: A legal term used for division-ing and and portioning of basic and fundamental laws/direct legislation by a Parliament, within a Major/Primary Law of a country or a company. For example Constitution of Pakistan, Articles of Association of any company/organisation etc. (7) SECTION: A term used for division-ing and and portioning of secondary laws of a state ,next to the constitution, providing definitions, regulating procedures and the punishment etc. For example Section 302 of Pakistan Penal Code and 154 of Criminal Procedure Code (8) RULE: A legal term used for division and partition of laws made by the Competent Authority having delegated powers of Legislation for regulating the internal affairs of the department/organisation to achieve tasks assigned by the Constitution. For example, Under Article 191, the Constitution empowers the Supreme Court for making Rules of procedures. Similarly the National Assembly may make adopt Business of Rules. (9) PARA: A term used for a minute and further division of the above mentioned terms of laws aiming at attraction of the Reader for similarities and contradiction in law if exists any. (10) PROVISION: A legal term used for additional part of the above mentioned terms for exception/protection regarding applicability of law. In other words, after defining the principal theme/subject of law, some exceptions are provided to safeguard others from mis-use of law and avoid technicalities and procedural flaws in ex*****on of the said law. For example. A High Court Judge may be posted in Federal Shari-at Court by transfer,,,,,Provided that the consent of the said Judge shall be obtained. Second part of this example is PROVISION. Now many question/objections arise, for example, (A) Why Article has been used in Qanoon-E-Shahadat Order 1984 ? (B) Why Order and Ordinances in Pakistan still intact as law for the last 3 decades although Ordinace/Order expires after 120 days suo moto? The answers go as under: In Pakistan almost majority of Ordinances/orders have been issued in Martial Law Period so these Ordinances/orders have been given protection by the Parliament under LFO/legal Frame Work Order and have now become permanent law. JUST TO REMOVE AMBIGUITY, FOR GENERAL PUBLIC ABOUT LEGAL PRACTITIONERS: On and Off, I have been asked for the differentiation of different designations/Nomenclature including Barrister (Bar-at-Law), Solicitor, Attorney-at-Law, Lawyer. Advocate, Attorney-General, Advocate-General, Prosecutor-General, State Council, Council at State Expense, Advocate-on-Record, Advocate District Bar, Advocate High Court, Advocate Supreme Court, Law-Clerk and Court-Associate. The general public and even the Legal professionals have not the exact defined answers to the above queries and may make good excuse to elaborate their jurisdiction, functions and responsibilities. Having perused the detail summery of the above mentioned terms, a simple attempt is made to define as follows: BARRISTER (Bar-at-Law): A legal professional/practitioner having membership/fellowship of UK Bar. Its neither a degree not a qualification but an hon-our for the fellow/lawyer of Common Wealth Countries. LLB is not a requirement for Bar-at-law in UK. A Barrister is entitled to appear before the courts of United Kingdom and its colonies, later known as Common Wealth Countries but this practice has been abandoned after 1949 and Bar-at-Law is an honor but it has no elemental aspect to become a lawyer but one has to fulfill the requirements of the local bar of the countries. In UK, Barrister can appear in courts of UK but they can not interact directly with parties/clients and they only put the arguments before the courts. 2) SOLICITOR: A Legal professional/practitioner in UK who makes and prepares legal cases including drafting and filing the petition/appeal. Only the Solicitor can interact the parties/clients directly but neither they can appear before the courts nor argue the cases although may present and interact with the court-staff. 3) ATTORNEY-AT-LAW: This term is used for a legal professional/practitioner in USA. A person who practices law at any forum is called, Attorney-at-Law, similar to the term "Advocate" used for legal practitioner in India and Pakistan. 4) LAWYER: A general term, globally used, for the person who practices law without specific forum/court including trial courts to the apex court/supreme court of any state. 5) ADVOCATE: A general term, used in India and Pakistan, for the person who practices law. The term is not confined for a specific forum/court but includes Magistrate courts/trial courts to the apex court/supreme court of India and Pakistan. 6) ATTORNEY-GENERAL: A person holding highest Law Office of a Federation, who represents Federation in the superior courts of a Federation, for example, Attorney-General for Pakistan. The Attorney General deals only the civil and constitutional matters and cannot represent Federation in criminal vases unless directed by the Courts to assist the Court meaning by playing a role of prosecution but that in cases when some constitutional post holder is trialed/proceeded against. 7) ADVOCATE-GENERAL: Equally a person who represents the Province/Federating Unit, in the superior courts including High Courts and Supreme Court, for example, Advocate-General, Punjab, KPK etc. The Advocate General deals only the civil and constitutional matters and cannot represent province in criminal cases unless directed by the Courts to assist the Court meaning by playing a role of prosecution but that in cases when some constitutional post holder is trialed/proceeded against. 8) PROSECUTOR-GENERAL: A person holding highest post of Prosecution Office of a Province, who represents province only in criminal cases before the superior courts, for example, Prosecutor-General, KPK etc. Similarly, the prosecution departments of each province has prosecutors at District and Sub-Divisional levels. There are also independent Prosecutors of Constitutional Authorities/Bureaus i.e. NAB, ANF etc. 8) STATE-COUNCIL: A legal practitioner especially appointed to represent Federation in superior courts in addition to the Additional and Deputy Attorney Generals. Occasionally, State Council are also appointed to represent federation in a particular case and once the cases decided its tenure comes to end. 9) Advocate District Bar: A legal practitioner who can appear before Districts Courts and equal forum. 10) Advocate High Court: A legal practitioner, who can appear before High Courts, Federal Shariat Court, Federal Service Tribunal, Tax Appellate Tribunals and equal forum. 11) Advocate Supreme Court: (10 years High Court Practice plus reported judgments) A legal practitioner who can appear before Supreme Court. 12) Advocate-on-Record: An Advocate Supreme Court having five years standing in Supreme Court may become an Advocate-on-Record who may draft and file the petition/appeal before Supreme Court. AOR shall direct interact with parties and the court offices; and Advocate Supreme Court only argue the case and does not interact with parties and Court Offices. 13) Law Clerk: A legal professional in USA who assist the Bench/judges in Court during the proceedings. 14) Court Associate: A legal professional/legal court staff in Pakistan, Supreme Court, who assist the Bench/judges during proceedings of the court.,,,,,,,Comments are welcome

Whether Legal Profession does not need to be streamlined and regulated:
Yesterday, one of the influential senior Advocate of Supreme Court entered my office and queried about status of his freshly instituted/filed petition on legal question of law while impugning/challenging the proceedings of Special Court. I welcomed the senior Advocate and offered for having a seat. the next movement, He again inquired about the status of the petition, being adjudicated for its examination and suitability for its maintainability and registration, meaning with to be a fit case for hearing under the original jurisdiction of the Supreme Court. My answer was, that the said petition is pending and following questions/objections to the petition are to be examined/decided by today, positively. 1) Whether Petitioner's any of the Fundamental Rights guaranteed by the Constitution of Pakistan under Articles 8 to 37, has been infringed/violated? 2) Whether the Petitioner has any loca standi having knocked right forum for re-deressal of his grievance? 3) Whether Petition is entertain-able under Article 184(3) of the Constitution 4) Whether, in absence of the petitioner, a petition can be filed/instituted in the Supreme Court. 5) Whether Cause of action has been established? The Senior Advocate, fall in arguments and reasoning that allegedly i have caused the delay in deciding the fate of the petition and also i have become a hindrance in provision of free and speedy justice to his clients/litigant parties. I too timely responded that the said petition has been received in the Office, Yesterday in the evening and will be finalized its fate of enter-maintainability or otherwise. And further, the petition contains some legal questions to be decided today and there is delay on part of the Office as it has been kept for only one and half day. However, the Senior Advocate did not agree and went upon arguing the flimsy and baseless grounds for the said delay in provision of justice. He stressed on the Legal Idiom/proverb i.e. Justice delay is justice denied. My arguments to the said proverb was: Justice in Harsh is Justice destruction. While facing so in satisfying me by his baseless arguments, the Senior Advocate made his hard movements to make a case for relief. He took personal and targeted me for causing delay in the petition and termed me a hindrance in the provision of free, fair and speedy justice. Next movement, My answer to the Advocate was very simple with following questions regarding his legal profession and advisor-ship to his client in the said petition by filing in the Supreme Court in initial consultation process. 1) Whether, you did not know that proceedings of special courts cannot be challenged in Supreme Court. 2) Whether You did not know that High Court is the proper forum by filing a writ petition? 3) Whether honestly, you have advised your client that this petition is not admissible in the Supreme Court?. By challenging his professional conduct and having heard my arguments on his professional conduct, He was shocked and made good excuse for leaving my office. The said movement, I was lit bit, doubted about my acts and responding the senior lawyer but on the other hand i was compelled to think and propose some legislation/law making for regularization the legal profession and conduct of the legal practitioners. Although, there are, Pakistan Bar Council Act, 1973, Legal Practitioner Act, 1973 and Provincial Bars Acts; and too there are properly constituted Regulating Bodies to regulate the legal profession and have check on the conduct of legal profession and its legal practitioner. It worth mentioning, that Pakistan Bar Council is the regulating body and functioning at equal footing with PMDC and Engineering, in the filed of Medical and Engineering, but unfortunately, this body (PBC) is neither playing its effective role to improve the education standard in the filed of law and judicial nor has regulate the legal profession in the true meaning, particular, the legal ethics and conduct of the legal practitioners. On and off, we observe that Advocate mis-behaves and mis-handled and usually complaints are processed for appropriate action against the legal practitioners but with no ultimate conclusion or required decision and justice is not done in these case. With apology, another aspect of the subject them, that we the legal professionals, primarily, do not come in this profession with background of pre-thought from secondary education/Schools like Doctors and Engineers but entered in this profession by incidents. Only 5 percents legal professionals have mind plan to become a lawyer or a judge while rest, after attempting all hard and dry, adopt this professional. In my humble view, we need more cream and outstanding people in this field because they make the basis of justice and equality in the society. The phenomena of justice delay in our society is attributed to the huge pend-ency which directly caused by these legal professionals who failed to give good advice and consultation to his clients. If the legal professionals advise his clients, not to file a frivolous case/petition, wherein, no case for relief can be made, i guarantee you that 80 percents pend-ency can be reduced in one year and trend of filing false cases can be avoided, if the legal professionals do right job and display sincerity with their profession. This is indeed true that in sub-continet, in particular, India and Pakistan, ratio of filing of false cases is high side due to the public in-civic sense to harass and engage the opposite party in court litigation. Even, parties engaged themselves in repeated round of litigation from the trial court to the apex court/supreme court, with intention to cause mental and financial harm to the other side. The Federal Government needs well time legislation/law making for effective regulation of the legal profession and setting new standards for legal and judicial education; and ethics of the legal practitioners in Pakistan. Once more sorry for the professionals concerned the legal and judicial fields and hope " No Offence" as this column has written in the best public interest aiming at provision of free, fair and speedy justice to all the citizens of Pakistan. Plz positive comments and proposals for regulating the legal profession in Pakistan, equally as Medical and Engineering.
