Fazil Law Firm (FLF) successfully defends its clients in an Election Tribunal case by getting dismissed an Election Petition on 07-03-2018 filed by opponent party. Mr. Abid Hussain Ranjha, Advocate (Managing Partner of FLF) was representing the clients in the case.

According to details, elections of local bodies of Islamabad Capital Territory were held in December 2015. From area of Jhangi Syedan, Mr. Gulfraz Khan and Mr. Malik Mehrban Ali Awan were declared winners on seat of Chairman & Vice Chairman of Union Council respectively by defeating the candidates of PML(N), PTI and PPP.

Mr. Khan & Mr. Awan contested the elections as independent candidates.

The runner up candidates, Mr. Syed Sibte Hassan and Mr. Rafaqat Hussain Shah Bukhari, who contested the election on the ticket of PML(N), challenged the elections on various counts by filing an Election Petition in the learned Election Tribunal, Islamabad.

After hectic court battle up-till Hon’ble Supreme Court of Pakistan, comprising over more than two years, the Election Petition has been dismissed on 07-03-2018 by the learned Election Tribunal, Islamabad headed by Mr. Mumtaz Hussain.

First woman arrested under Pakistan's new cyber-crime law

SIALKOT: The Federal Investigation Agency (FIA) on Saturday arrested a Pakistani woman for blackmailing activities on social media, which makes her the first female to be taken into custody under the recently-passed cyber-crime law.

The woman – Sadia Mirza – has been accused of blackmailing Ahsan Rana, a resident of London. Hassan Rana, the latter’s brother, filed the complaint and alleged that Mirza had sent messages to Rana over social networking website Facebook, demanding money.

As per the FIR, Mirza has been charged with “sending threatening, abusive, and lewd messages.”

The investigation and arrest were undertaken by a team headed by Inspector Humaira Kanwal, and a case has subsequently been registered according to the Prevention of Electronic Crimes Act, 2016 – clauses 20 (1) and 24(b)(c).

Mirza has been shifted to the women section of the local police station on remand.

This development comes as part of measures carried out by the federal government in an effort to control social media activity in Pakistan.

It is now mandatory to file application not only before SHO but to higher police officers prior to filing petition u/s 22-A Cr.P.C. The Supreme Court of Pakistan has held this as follows:

“The ex-officio Justice of the Peace, before issuance of a direction on a complaint for the non-registration of a criminal case under sub-section (6)(i) of section 22-A, Code of Criminal Procedure must satisfy himself that sufficient material is available on the record, such as application to the concerned SHO for registration of the criminal case and on his refusal or reluctance, complaint to the higher police officers i.e. DPO, RPO etc., to show that the aggrieved person, before invoking the powers of ex-officio Justice of the Peace, had recourse to the high ups in the police hierarchy.”
