There are signs that China is taking a more active role in trying to resolve the issue of cross-border terrorism between Pakistan and Afghanistan.

Pakistan had last month launched Operation Ghazab lil-Haq after a series of deadly terrorist attacks in this country were traced to Afghanistan.

The hostilities continue without any major sign of a negotiated settlement.

However, if Beijing’s efforts succeed, perhaps a way out can be found to restore peace while addressing Pakistan’s valid concerns about Kabul offering sanctuary to terrorist groups such as the TTP.

Pakistan has to maintain a delicate balance where the geopolitics of the US-Israeli aggression against Iran are concerned. It involves condemning the aggression against Iran, while not castigating America too harshly, and censuring Tehran’s counter-attacks on GCC allies. Perhaps the difficulty of maintaining this balance was revealed at the UN Security Council on Wednesday, where Pakistan supported two competing resolutions linked to Iran.

The first, sponsored by Bahrain, criticised “egregious attacks” by Tehran, targeting the Gulf sheikhdoms and Jordan. While the Bahraini document was adopted, a Russian resolution mourning the “tragic loss of life” during the hostilities was not, with the US envoy to the UN accusing Moscow of protecting “its partner Iran”.

رضا مندی سے زناء اور ریپ کیس کا فیصلہ۔
جسٹس بابر ستار کا دبنگ فیصلہ

اسلام آباد کے نواحی علاقے میں ایک گھر میں رات تقریباً نو بجے بیس سالہ عینی جاگ رہی تھی۔ اس کے والدین اپنے چھوٹے بیمار بیٹے کو ہسپتال لے کر گئے ہوئے تھے جبکہ اس کے چھوٹے بہن بھائی گھر کے ایک کمرے میں سو رہے تھے۔ اسی دوران دروازے پر دستک ہوئی۔ عینی نے پوچھا تو باہر سے آواز آئی کہ وہ ان کا ہمسایہ شہزاد ہے اور پانی چاہیے۔ عینی نے جیسے ہی دروازہ کھولا، شہزاد نے اسے اسلحے کے زور پر ایک کمرے میں لے جا کر اس کے ساتھ زیادتی کی۔ جاتے ہوئے اس نے دھمکی دی کہ اگر اس واقعے کے بارے میں کسی کو بتایا تو اسے سنگین نتائج بھگتنا ہوں گے۔ خوف اور بدنامی کے ڈر سے عینی خاموش رہی، مگر کچھ عرصے بعد وہ حاملہ ہو گئی۔

تقریباً آٹھ ماہ بعد جب اس کے والدین کو اس بات کا علم ہوا تو عینی نے انہیں ساری حقیقت بتا دی۔ ابتدا میں خاندان کی عزت بچانے کی امید میں عینی کے والدین نے جرگہ بھیجا تاکہ شہزاد اس سے شادی کر لے، مگر شہزاد نے نہ صرف انکار کر دیا بلکہ یہ بھی کہا کہ اس نے ایسا کچھ نہیں کیا۔ اس کے بعد مجبور ہو کر عینی کے والدین نے اس کے خلاف زیادتی کا مقدمہ درج کرا دیا۔ چند ہی دن بعد عینی نے ایک بچی کو جنم دیا۔ پولیس نے عینی کا طبی معائنہ کروایا، شہزاد کو گرفتار کیا اور بچی کی پیدائش کے بعد اس کا اور شہزاد کا ڈی این اے ٹیسٹ بھی کروایا۔ میڈیکل رپورٹ میں جسم پر واضح مزاحمت یا تشدد کے نشانات تو نہیں ملے، مگر ڈی این اے رپورٹ کے مطابق 99.99 فیصد امکان تھا کہ بچی کا باپ شہزاد ہی ہے۔

مقامی سیشن کورٹ میں مقدمہ چلا جہاں مدعی فریق نے عینی سمیت آٹھ گواہ پیش کیے۔ ملزم نے عدالت میں مؤقف اختیار کیا کہ اس نے عینی کے ساتھ کوئی غلط کام نہیں کیا اور یہ بچی کسی اور کی ہے، جبکہ اس پر مقدمہ اس لیے بنایا گیا ہے تاکہ اسے بلیک میل کر کے شادی پر مجبور کیا جا سکے۔ مکمل ٹرائل کے بعد سیشن کورٹ نے شہزاد کو 14 سال قیدِ با مشقت اور 50 ہزار روپے جرمانے کی سزا سنائی۔ اس فیصلے کے خلاف شہزاد نے اسلام آباد ہائیکورٹ میں اپیل دائر کر دی۔

اپیل میں ملزم کے وکیل نے دلائل دیے کہ ایف آئی آر آٹھ ماہ کی تاخیر سے درج ہوئی، واقعے کا کوئی عینی گواہ موجود نہیں، اور میڈیکل رپورٹ میں جسم پر مزاحمت کے نشانات بھی نہیں ملے۔ ان کا کہنا تھا کہ اگر زبردستی ہوئی ہوتی تو لڑکی شور مچاتی جس سے اس کے سوئے ہوئے بہن بھائی جاگ جاتے۔ مزید یہ بھی کہا گیا کہ جرگے کے ارکان یا والدین بطور گواہ عدالت میں پیش نہیں ہوئے۔

اسلام آباد ہائیکورٹ کے ڈویژن بنچ نے اس اپیل کی سماعت کی اور جسٹس بابر ستار نے 31 صفحات پر مشتمل تفصیلی فیصلہ تحریر کیا۔ عدالت نے نہ صرف پاکستانی قوانین بلکہ بھارت اور مغربی ممالک کی قانونی نظیروں کو بھی مدنظر رکھتے ہوئے اعتراضات کا جائزہ لیا۔ فیصلے میں کہا گیا کہ ایسے واقعات کی رپورٹ میں تاخیر عموماً معاشرتی شرم، خوف اور بدنامی کی وجہ سے ہوتی ہے۔ دنیا بھر میں بڑی تعداد میں ایسے جرائم رپورٹ ہی نہیں ہوتے، اس لیے صرف تاخیر کو بنیاد بنا کر شک نہیں کیا جا سکتا۔ عدالت نے یہ بھی قرار دیا کہ جسم پر تشدد یا مزاحمت کے نشانات کا نہ ہونا اس بات کا ثبوت نہیں کہ واقعہ رضامندی سے ہوا، کیونکہ خوف اور صدمے کی حالت میں متاثرہ شخص مزاحمت کرنے کے قابل بھی نہیں رہتا۔

عدالت نے یہ بھی نوٹ کیا کہ ملزم نے نچلی عدالت میں رضامندی کا مؤقف اختیار ہی نہیں کیا بلکہ مکمل انکار کیا تھا، جبکہ ڈی این اے رپورٹ اس کے دعوے کے برعکس حقیقت کو ثابت کرتی ہے۔ سب سے اہم بات عدالت نے یہ قرار دی کہ زیادتی کے مقدمات میں اگر متاثرہ خاتون کی گواہی کو طبی یا سائنسی شواہد سے تقویت مل رہی ہو تو اضافی عینی گواہوں کی عدم موجودگی مقدمے کو کمزور نہیں بناتی۔

ان تمام نکات کی بنیاد پر اسلام آباد ہائیکورٹ نے سیشن کورٹ کا فیصلہ برقرار رکھتے ہوئے شہزاد کی اپیل مسترد کر دی۔ پاکستان میں ایسے مقدمات میں سزا کی شرح بہت کم سمجھی جاتی ہے، اس لیے یہ فیصلہ آئندہ کے لیے ایک اہم قانونی نظیر کے طور پر دیکھا جا رہا ہے اور اس سے متاثرین کے لیے انصاف کے امکانات مضبوط ہونے کی امید ظاہر کی جا رہی ہے۔

As hostilities continue following the Israeli-American joint aggression against Iran, there seems to be no visible pathway to de-escalation. Instead, as US President Donald Trump reiterated yesterday, the attacks may go on for weeks or longer.

This ominous pronouncement should set off alarm bells worldwide, as a notoriously erratic US administration, in tandem with its Zionist allies, has launched another doomed regime change operation, even though the Pentagon chief, in typically intemperate fashion, said on Monday that this is not “a regime change war”.

Not content with the brutal assassination of Ayatollah Ali Khamenei, the warmongers in Washington and Tel Aviv are seeking total capitulation from Tehran. But as the past few days have shown, despite painful blows, Iran is still functioning.
