Whenever we discuss borderline cases, my mind invariably turns to a particular judgment under the recent CNSA 1997 amendment act. In he**in cases, quantities exceeding 499 onwards do not fall under the prohibitory clause of 497 CRPC. However, in this judgment, Honorable Tariq Mehmood Jahangiri, Justice of the Islamabad High Court, eloquently elucidated the importance of examining the merits of each case and granting a lesser sentence to the accused. Not only did he do this, but he also provided references to case laws established before this amendment. Another relevant case law is that of Criminal Micelleonous decided in 2023 by Justice Arbab of the Islamabad High Court, who emphasized the importance of police investigations in arresting accused individuals in narcotics cases. This trend is becoming pervasive, and it's undeniable that authorities often fail to recover money, inquire about the intended sale, or identify the beneficiaries or purchasers, leading to an increase in such cases. The superior courts must address this issue, as must the police in combating these crimes. Mere possession of narcotics should not automatically imply culpability; rather, attention should be focused on tracing the origin, purchase, and intended sale of the substances.

In the matter of Azmat Jahan Vs Additional District Judge and others (Citation: 2023 MLD 92, Lahore High Court), the petition was dismissed on the basis that a deceased sister cannot assert a claim for dowry articles within the jurisdiction of Family Courts. To establish entitlement, she must demonstrate her status as the successor to her late sister and pursue the husband of the deceased. Furthermore, if she can establish her inheritance rights, she should approach the Civil Court for the claimed property. It is emphasized that only parents are eligible to approach Family Courts for dowry articles, given that they provided it at the time of marriage.

I would like to provide feedback on the services I received regarding the drafting of a divorce deed, its ex*****on, and the step-by-step process for executing it when the husband has delegated these rights in the Nikkah Nama. Additionally, I submitted a comprehensive application to the Arbitration Council in Islamabad. Remarkably, all these tasks were successfully completed in a single day. Achieving such a seamless resolution of these services is indeed a relief.
