Peshawar High Court Remands Digital Banking Fraud Cases
In a consolidated judgment, the Peshawar High Courtset aside the orders of the Banking Mohtasib and the President of Pakistan, remanding digital banking and ATM fraud cases for a fresh determination of liability. The Court ruled that under the Payment Systems and Electronic Fund Transfers Act, 2007, banks cannot be held liable if account holders voluntarily compromise their sensitive credentials (OTPs/PINs) to fraudsters.

Barrister Babar S. Imran and Barrister Mustafa Durrani successfully represented Allied Bank Limited in a total of approximately 15 clubbed cases, marking a pivotal legal milestone for banking consumer liability and electronic fund security.

⚖️ DECISIVE DOUBLE VICTORY FOR OVERSEAS PAKISTANIS!

Our chambers has successfully defeated the opponent's jurisdictional hurdles before the Special Court, Islamabad, representing our client, an Overseas Pakistani, in the crucial matters of applicantion under 12(2) CPC and a Declaratory suit.

The Court resoundingly dismissed the opposite party's technical applications under Order VII Rule 10 CPC, firmly ruling that the Establishment of Special Courts (Overseas Pakistani Property) Act, 2024 is an overriding special law fully empowered to adjudicate fraud, inheritance, and property title disputes to protect expatriate rights.

With the jurisdiction of the Special Court strongly reaffirmed, the path is now clear to fight the case on its true merits!
