We are pleased to share that the Federal Service Tribunal, Islamabad has accepted the appeal of our client. The Hon’ble Tribunal set aside the impugned ordees and directed the respondents to grant pay protection to our client with effect from the date of his joining in terms of his last pay drawn, along with all consequential benefits.

The Tribunal held that service terms cannot be altered to the disadvantage of an employee upon permanent absorption and that similarly placed employees are entitled to equal treatment under settled principles of law. The judgment placed reliance upon the cases of Mr. Shamoon Ashraf Hashmi and Mr. Muhammad Banaras, wherein pay protection had been granted to similarly placed government servants under identical circumstances. Mr. Sanaullah Khan, Advocate High Court, represented the appellant before the Federal Service Tribunal, Islamabad.

Team Lex Elit achieves another success before the Federal Service Tribunal. Mr. Sanaullah Khan, representing Team Lex Elit, successfully defended the private respondent in a service matter concerning ante-dated promotion and officiating appointment. It was argued that officiating promotion does not confer any vested right to regular promotion in the absence of a clear vacancy. The honorable Tribunal upheld the established principle of law and dismissed the appeal accordingly. Team Lex Elit continues to demonstrate excellence in service and constitutional litigation.

In a reported judgment, the Federal Service Tribunal set aside the major penalty of compulsory retirement imposed upon a civil servant just two weeks before his superannuation. The Honourable Tribunal held that such action was in violation of Rule 54-A of Fundametal Rules and Rule 417-A of the Civil Service Regulations, as well as the relevant provisions of the ESTA Code, which require expeditious disposal of departmental proceedings, particularly when an employee is at the verge of retirement and pension papers are required to be finalized in advance. The Tribunal observed that concluding proceedings at the eleventh hour and imposing a major penalty adversely affecting pensionary benefits defeats the spirit of service jurisprudence and causes serious prejudice to vested rights.

The learned Federal Service Tribunal has allowed an appeal filed by Lex Elit on behalf of its client, setting aside the penalty of compulsory retirement. The Tribunal observed that the Inquiry Officer had recommended a minor penalty and that the competent authority, while imposing a major penalty, failed to record reasons for disagreement. It was further held that no deliberate embezzlement was established, the alleged overpayments had already been recovered, and the matter at most constituted negligence. Declaring the impugned order disproportionate and legally unsustainable, the Tribunal upheld the recommendation of minor penalty.

🏛️ Another Legal Victory for Team Lex Elit!

Team Lex Elit has successfully secured a favorable judgment before the Federal Service Tribunal in a case involving alleged unauthorized absence of 200 days on medical grounds. Mr. Sanaullah Khan effectively represented the client, resulting in the condonation of delay and the setting aside of the major penalty of removal from service being excessive penalty for the charge alleged.

The Honorable Tribunal relied upon landmark precedents including 2025 SCMR 708, 2008 SCMR 214, and 2020 PLC (CS) 200, reinforcing the legal position and ensuring justice prevailed.

Lex Elit LLP is pleased to announce a significant victory before the Federal Service Tribunal, Islamabad, where Partner Mr. Sanaullah Khan, Advocate High Court, represented appellant Muhammad Riaz. Despite being senior, the appellant was unjustly deferred in a DPC due to a minor penalty, while juniors were promoted, and he received promotion only with immediate effect shortly before retirement. Relying on authoritative precedents (2016 SCMR 1784; 2023 SCMR 1514), the Tribunal held that a minor penalty cannot bar promotion and such deferment violated Article 25 of the Constitution. The appeal was allowed, directing ante-dated promotion with seniority and consequential benefits, marking another milestone achievement for Lex Elit LLP in safeguarding civil servants' rights.
