In the recent judgement of the Divisional Bench of Islamabad High Court, it has diluted the distinctive nature of Narcotics Trials which are regulated by the special CNSA law.

Key points:
1. Presumption u/s 29 of CNSA shifts the onus of proof on the accused when the prosecution has established the recovery of contraband. This jurisprudence was also somehow appreciated in Daniel Pearl case.
2. The CNS rules requiring submission of representative sample with 72 hrs are directory in nature and circumstances has to be taken into consideration.
3. Prosecution while submitting report u/s 173 CrPC is required to take into consideration previous convictions (if any) and submit report to that as well for enhanced punishment.
4. It is so far well established fact that police witnesses are as good witnesses as any other witness and there testimony can only be discarded by proving the elements of animus, malice & malafide towards the accused.
