6 legal words of the day (25.12.2014)
1. Advocacy:
Definition= Speaking on behalf of clients in court
hearings. The ability to argue a case or a cause well.
Example= The art of Advocacy is often neglected by
busy modern lawyers. Advocacy is the art of using
the full power of the words you speak.
2. Affidavit:
Definition= a statement of facts, usually written,
which the author has sworn is true and which can
then be used as evidence in a trial. A document
containing a set of facts which the person making
swears are true.
Example= The Expert witness submitted his evidence
on the condition of the ship in an affidavit. OR The
Plaintiff swore an Affidavit as to how much money
the collision had cost him.
3. to Affirm (verb)
Definition= To confirm as true, to state something
solemnly before a court without swearing the oath, to
confirm the decision of a lower court as correct
Example= We will ask the Supreme Court to affirm
the decision of the original court hearing. OR I affirm
the decision of my fellow Judge.
4. de facto corporation = A business that has not
completed all of the legal steps to become a
corporation will be treated as a corporation by the
court to shield the directors, officers, and
shareholders who in good faith thought they were
operating the business as a duly formed corporation.
Compare: de jure corporation.
5. de jure corporation = A corporation formed in
compliance with all applicable laws.
6. De Minimis = Trifling or of little importance. Usually
refers to something so small, whether in dollar terms,
importance, or severity, that the law will not consider
it.
