FIR رجسٽريشن ۾ دير يا انڪار — پوليس جا فرائض لازمي آهن
پوليس اسٽيشن ۾ FIR داخل ڪرڻ يا ان ۾ دير ڪرڻ جي وسيع رواج بابت سپريم ڪورٽ پنهنجون ڳڻتيون ظاهر ڪيون آهن. قانون موجب هر پوليس آفيسر تي لازمي آهي ته جڏهن به ڪو قابل گرفت جرم رپورٽ ٿئي، فوراً FIR داخل ڪري. پوليس آفيسر کي نه انڪار ڪرڻ جو اختيار آهي ۽ نه دير ڪرڻ جو، ڇو ته اهڙو عمل متاثر ڌر، مجرمان ۽ شهري حقن تي شديد اثر وجهي ٿو ۽ ثبوتن کي غلط استعمال جو موقعو ڏئي ٿو.

سپريم ڪورٽ واضح ڪيو ته دير جا سبب جهڙوڪ رواجي ثقافتي رواج، شڪايت ڪندڙ جي ترجيح، صلح يا مذهبي ۽ طبي سبب Cr.P.C جي ضابطن سان مطابقت نٿا رکن. پوليس جو ڪم ماڻهن جي خدمت ڪرڻ آهي نه ته طاقتور ۽ اثر و رسوخ رکندڙن کي فائدو پهچائڻ. هر پوليس آفيسر تي لازمي آهي ته Cr.P.C سيڪشن 154 جي تحت پنهنجو فرض مڪمل طور سرانجام ڏئي، ۽ ڪيس داخل ڪرڻ ۾ دير يا انڪار نه ڪري.

اهو پڻ ذڪر ڪيو ويو آهي ته دير يا انڪار خاص طور تي سماجي طور پٺتي پيل، محروم ۽ گهٽزور طبقي جي حقن تي اثرانداز ٿئي ٿو، ۽ اهڙو عمل پوليس ۽ عدالتي نظام ۾ عوام جو اعتماد ختم ڪري ٿو. سڀني صوبن جي پوليس جنرلز ۽ پراسڪيور جنرلز کي هدايت ڪئي وئي آهي ته موثر قدمن سان يقيني بڻايو وڃي ته ڪنهن به پوليس آفيسر طرفان سيڪشن 154 تحت ڪيس داخل ڪرڻ ۾ دير يا انڪار نه ٿئي ۽ اسٽينڊرڊ آپريٽنگ پروسيجر تي عمل ڪيو وڃي.

Delay or refusal in FIR registration is a serious issue highlighted by the Supreme Court.

Every officer in charge of a police station is legally bound to register an FIR immediately upon receiving information regarding a cognizable offence under Section 154 Cr.P.C. No officer has the authority to delay or refuse registration. Delay or refusal adversely affects the rights of victims, accused, and citizens, and provides an opportunity to manipulate evidence or falsely implicate innocent persons.

The Court emphasized that excuses such as cultural practices, complainant preference, reconciliation attempts, religious beliefs, or medical priorities are not acceptable under Cr.P.C. The police force exists to serve the public, not to favor the powerful or influential. Officers must strictly perform their statutory duties, and failure to do so undermines public confidence in the criminal justice system.

The Supreme Court directed Inspector Generals and Prosecutor Generals of all provinces to take effective measures to prevent refusal or delay in FIR registration, to frame standard operating procedures, and to ensure that police officers respect the statutory duties under Section 154 Cr.P.C. The trust of the people in the impartiality and efficiency of the police and the criminal justice system is crucial for constitutional governance.
