PLD 2026 Lahore 332 | PLJ 2026 Lahore 43

In a significant ruling concerning child custody, the Lahore High Court decided in favor of foster parents regarding the custody of a 13-year-old child.

🔹 The Honorable Court, through a detailed judgment, set aside the trial court’s decision and emphasized that in custody matters, the primary consideration is always the welfare, mental well-being, and preference of the child.

🔹 The Court observed that the child consistently expressed a desire to live with the foster parents—even after spending time with the biological parents, the child maintained the same stance.

🔹 While acknowledging that biological parents generally have a preferential right, the Court clarified that such preference is not absolute and must yield where the child’s best interests demand otherwise.

🚨 دفعہ 144 کیا ہے؟ مکمل رہنمائی

پاکستان میں ضابطہ فوجداری (CrPC) کی دفعہ 144 ایک اہم قانونی اختیار ہے جس کے تحت انتظامیہ امن و امان برقرار رکھنے کے لیے عوامی سرگرمیوں پر عارضی پابندیاں عائد کر سکتی ہے۔

⚖️ اس کے تحت چار یا اس سے زائد افراد کے اجتماع، جلسے جلوس اور اسلحہ کی نمائش پر پابندی لگائی جا سکتی ہے۔

📌 یہ حکم صرف اس وقت جاری کیا جاتا ہے جب امن عامہ کو خطرہ ہو یا کسی قسم کے فساد کا اندیشہ ہو۔

⏳ عام طور پر اس کی مدت 2 ماہ ہوتی ہے، تاہم حکومت ضرورت کے مطابق اس میں توسیع کر سکتی ہے۔

⚠️ خلاف ورزی کی صورت میں تعزیرات پاکستان (PPC) کی دفعہ 188 کے تحت کارروائی ہو سکتی ہے، جس میں قید یا جرمانہ یا دونوں شامل ہیں۔

Possession = Protection until partition. No self-help, no force — only the court can divide joint land.

Supreme Court settles it: If an amount is only _entered in your account_ or you just have _permission to withdraw_ from a partner’s share, but you haven’t actually received cash — it’s NOT taxable income.

Tax law taxes _real income_, not paper entries. Bookkeeping ≠ Tax liability.

In Criminal Law: Doubt = Acquittal ⚖️

The prosecution’s job isn’t easy. To convict someone, they must prove guilt _beyond reasonable doubt_. That’s the gold standard.

Key rules from 2019 SLD 258:

- Benefit of doubt always goes to the accused if evidence is contradictory or weak
- Medical evidence alone≠ conviction
- Weapon recovery alone ≠ conviction
- Motive must be proved— without it, the case weakens

Criminal conviction needs a complete chain. One broken link = accused walks free.

- تضاد ہو تو فائدہ ملزم کو

Second Marriage Without Permission? Only Family Court Can Hear It ⚖️

The law is clear under the Muslim Family Laws Ordinance, 1961: A man must obtain permission from the Arbitration Council before contracting a second marriage.

Key Legal Position — 2025 MLD 385:

- Exclusive Jurisdiction: Only Family Courts can try cases of second marriage without permission
- Not a police matter: Ordinary criminal courts do not have direct jurisdiction
- Offence under Section 6 MFLO: Violation leads to punishment of fine + imprisonment
- Wife’s remedy: Complaint must be filed in Family Court, not FIR at police station

This judgment protects legal procedure and prevents misuse of criminal law in family disputes. Jurisdiction matters.

FBR can’t tax everyone. Know the limit. 🌍⚖️

Sindh High Court rules: Non-resident insurance companies based permanently in the UK & USA cannot be charged income tax in Pakistan.

Why? Tax law 101:
- No Permanent Establishment in Pakistan = No Income Tax in Pakistan
- Double Tax Avoidance Agreements (DTAAs) protect foreign entities
- Physical/operational presence matters more than just doing business

International tax has boundaries. FBR jurisdiction stops where “permanent establishment” doesn’t exist.

⚖️ اہم عدالتی فیصلہ — جہیز کے مقدمات میں اہم رہنمائی

سپریم کورٹ آف پاکستان نے واضح کیا ہے کہ جہیز کے سامان کی بازیابی کے لیے صرف بیوی کا بیان اور حلفیہ بیان بھی کافی ہو سکتا ہے، اور رسیدوں کی عدم موجودگی دعویٰ کو کمزور نہیں کرتی۔

یہ فیصلہ اس بات کی عکاسی کرتا ہے کہ فیملی کورٹس تکنیکی قانونی پیچیدگیوں کے بجائے انصاف اور حقیقت کو ترجیح دیتی ہیں۔
