Sa batas, walang general prohibition laban sa pag-video ng mga taong nag aaway o nag-i-eskandalo sa public area ng mall. Ang ganitong video ay maaari pang gamiting ebidensiya sa kaso, halimbawa sa assault, oral defamation, damages, basta may kinalaman sa isyu at maipakitang totoo at hindi peke. Dahil ang common areas ng mall ay bukas sa publiko, mababa ang reasonable expectation of privacy doon, kaya’t mahirap umangal na nalabag ang privacy mo kung ikaw mismo ang nakikipag eskandalo sa harap ng maraming tao.

Pero tandaan na ang mall ay private property; puwede itong magtakda ng house rules gaya ng “bawal mag video,” at puwedeng sitahin o paalisin ang ayaw sumunod (exercise ng right to exclude ng may ari). Hindi ito awtomatikong krimen, pero contractual/civil consequence ito sa pagitan ng mall at customer. Hindi rin puwedeng pilit agawin o burahin ng guard ang video sa cellphone.

Ang MARRIED TO sa land title ay sinasabi lang ang civil status ng may-ari, hindi ito awtomatikong ebidensya na conjugal ang property. Ang asawa na MARRIED TO ay walang direktang real right sa titulo base lang sa katagang iyon, pero maaaring may conjugal share siya kung mapapatunayang nakuha ang property habang kasal at sakop ng conjugal/community property.

HINDI puwedeng i-notarize ang dokumento ng kapatid mo kung hindi siya mismo ang personal na haharap sa notary. Ang pirma lang niya sa papel at dala mong ID niya ay hindi sapat.

Under the Notarial Law and the 2004 Rules on Notarial Practice, a notary public cannot notarize a document if the signatory does not personally appear and is not properly identified through competent evidence of identity.

May mga tama at legal na proseso kung paano makapag notaryo kahit wala ang signatory.

Oo. Pwede kang magpagawa at pumirma ng Special Power of Attorney (SPA) habang nasa abroad ka. Pero para tanggapin sa Pilipinas, kailangan itong ma-authenticate: Apostille kung ang bansa mo ay kasama sa Apostille Convention; kung hindi, ipa-legalize o red ribbon sa Philippine Embassy/Consulate.

Under RA 9262, Victim-survivors who are found by the courts to be suffering from battered woman syndrome do not incure any criminal and civil liability notwithstanding the absence of any of the elements for justifying circumstances of self-defense under the Revised Penal Code. In the determination of the state of mind of the woman who was suffering from battered woman syndrome at the time of the commission of the crime, the courts shall be assisted by experts.

RES PIRIT DOMINO means: the thing perishes with its owner. In sales, the party who owns the thing at the time of loss bears the risk, unless the contract validly says otherwise. Ownership passes only upon delivery.

The dealership bears the loss. Even if Juan fully paid, risk stays with the seller until ownership transfers upon delivery; here, the motorcycle was destroyed before delivery.

“The ownership of the thing sold shall be transferred to the vendee upon the actual or constructive delivery thereof.” — Civil Code, Art. 1477

Here, Juan fully paid, but the dealership was to deliver the motorcylce. The unit burned during the seller’s delivery process before Juan (or his bailee) received it.

Under Art. 1477, ownership had not yet transferred because there was no actual or constructive delivery. Under Art. 1504, the goods remain at the seller’s risk until ownership transfers.

As in the case of Norkis Distributors Inc Vs. Court of Appeals G.R. No. 91029 payment/processing alone does not constitute delivery or transfer of ownership; thus, risk had not shifted.
Because there was no delivery, ownership had not transferred; therefore, the loss is the dealership’s under res perit domino, consistent with Articles 1477 and 1504 of the Civil Code and the ruling in Norkis. The exception does not apply since no delivery to Juan or his bailee had occurred.

Ang 13th month pay ay government‑mandated. Ito ay katumbas ng 1/12 ng kabuuang basic salary na kinita sa buong taon, at pro‑rated kung hindi kumpletong taon ang napagtrabahuan. Buong taon: 13th month pay = kabuuang basic salary sa taon ÷ 12.
Mid‑year hire o separated: pro‑rated batay sa aktwal na basic salary na kinita sa taon.
Halimbawa ng pormula:
13th month pay = (Kabuuang basic salary sa taon) / 12
Kung di kumpletong taon, ang makukuha ay pro‑rated ayon sa aktwal na kinita.
