In this case, the Court found the father guilty of r**e, emphasizing that in incestuous cases, especially involving minors, physical resistance is not required to establish lack of consent. The ruling affirms that when the offender holds moral ascendancy, such as a parent over a child, intimidation can be psychological or emotional, making resistance unrealistic or impossible.
