1. Q: "Attorney, mayroon po bang form o template para sa KASUNDUAN sa barangay?"

A: "Sa ilalim po ng 'KATARUNGANG PAMBARANGAY: A HANDBOOK' na isang proyekto ng DILG, mayroong Katarungang Pambarangay Form No. 16 para sa AMICABLE SETTLEMENT. Kailangan ang ano mang mapagkasunduan sa barangay maayos na naka-dokumento at mayroong attestation o pagpapatunay ng Punong Barangay o Pangkat Chairman. Makikita po ito sa ika-31 na pahina."

2. Q: "Ano pong mangyayari kung ang KASUNDUAN po ay handwritten o nakasulat lamang at officer of the day lamang po ang naka-pirma?"

A: "Ito po ay maaring hindi tanggapin sa Korte bilang ebidensiya dahil sa hindi nito pag-ayon (non-compliance) sa nakasaad sa Katarungang Pambarangay Law na nakapaloob sa Local Government Code."

(Section 411 of the Local Government Code provides: "Form of settlement. - All amicable settlements shall be in writing, in a language or dialect known to the parties, signed by them, and attested to by the lupon chairman or the pangkat chairman, as the case may be. When the parties to the dispute do not use the same language or dialect, the settlement shall be written in the language known to them.") #

Q: "Attorney, mayroon po kaming KASUNDUAN sa barangay. Paano ko po ito ipapatupad?"

A: Sa ilalim ng 2022 Rules on Expedited Procedures in the First Level Courts (Municipal Trial Courts), ang barangay amicable settlement and arbitration award o KASUNDUAN sa barangay ay maaring ipatupad sa pamamagitan ng pagsampa ng Small Claims Case na gamit lamang ang form mula sa husgado at hindi kaillangan ng abogado, kung ang money claim o perang hinahabol ay hindi hihigit sa Php1,000,000 at walang pagpapatupad na isinagawa ang Barangay sa loob ng anim (6) na buwan mula sa petsa ng KASUNDUAN.

Kung ang money claim ay higit sa Php1,000,000 ngunit hindi hihigit sa Php2,000,000, ito ay maaring isampa pa rin sa ilalim ng Expedited Rules ngunit Summary Procedure na ang siyang susundin at kinakailangan na ng appearance ng abogado sa Preliminary Conference (Sec. 12, Rule III).

Q: "Attorney, gusto ko po sana ipawalang bisa ang aking kasal. Ano pong mga dokumento ang kailangan ko pong ihanda?"

Answer:

Based on OCA Circular No. 63-2019 (for purposes of establishing jurisdictional requirements of residency):

1. Sworn Certification with House Location Sketch issued by Barangay;

2. Sworn Statement of Counsel of Record (Verification of Residency for period of at least six (6) months);

3. Utility bills (at least six (6) months prior to filing of petition;

4. Government issued ID or Company ID with photograph and address issued at least six (6) months prior to filing of petition;

5. If applicable, notarized lease contract and receipt for rental payments at least six (6) months prior to filing of petition;

6. Transfer Certification of Title or Tax Declaration or Deed of Sale in the name of petitioner wherre he/she resides;

7. Collusion report from the deputized Public Prosecutor;

Main Evidence:

8. Judicial Affidavits of at least three (3) witnesses (preferably, non-relatives), and of the petitioner;

9. If ground is psychological incapacity, psychological report from expert witness; and

10. Such evidence as may prove the grounds alleged (e.g. Medical Certificate in case of physical abuse or Police Report). #
