“We had probable cause, so we arrested.”

That’s what they said.

But when the case reached court, the real issue was not what they believed.
It was whether the arrest followed the law.

Because warrantless arrests are not based on belief alone. They are allowed only in very specific situations:

First: In flagrante delicto (caught in the act)
The officer must actually see the person committing, attempting to commit, or having just committed a crime.
Not based on reports. Not based on suspicion.
It has to be direct, personal observation.

Second: Hot pursuit arrest
A crime has just been committed, and the officer has personal knowledge of fresh facts linking the person to that crime.
Not information from days ago. Not secondhand accounts.
The facts must be recent and personally known.

Third: Escapee
The person has escaped from detention or custody.
This one is straightforward.

Outside of these three, the rule is clear:
Get a warrant.

In our case, none of these were present.

No one was caught in the act.
There were no fresh, personal facts.
Our client was not an escapee.

What existed was an “investigation” and a claim of “probable cause.”

That was not enough.

The court saw it for what it was. An arrest made outside the exceptions. An arrest that should have required a warrant.

Our client was facing a charge punishable by reclusion perpetua.

But because the arrest did not comply with the law, the case could not stand.

Our client was acquitted.

That’s the reality.

In criminal law, it’s not just about who you accuse.
It’s about how you build the case from the very beginning.

May sumalubong, may saglit na komosyon, may mga taong hindi mo kilala.
Pagdating ng mga pulis, may nakuha raw sa iyo.

Shabu.

Sa papel, malinaw ang kwento.
May narekober. May nahuli. May kaso.

Pero sa ilalim ng batas, hindi doon nagtatapos ang usapan.

Paano ito napunta sa iyo?
Sino ang unang humawak?
Saan ito minarkahan?
May mga saksi ba?
Naidokumento ba nang maayos bawat hakbang?

Ito ang tinatawag na chain of custody.
Hindi ito teknikalidad lang. Ito ang nagsisiguro na ang ebidensya na ipinapakita sa korte ay siya ring ebidensyang sinasabing nakuha sa iyo.

Kapag may puwang sa kwento…
kapag may nawawalang detalye…
kapag hindi malinaw ang bawat galaw…

nagiging tanong ang ebidensya mismo.

Dahil minsan, ang laban ay hindi lang kung ano ang nakita.
Kundi kung paano ito napatunayan.

Isang paalala: Ang paggamit ng loose firearm o hindi rehistradong baril ay hindi lamang ilegal—may kaakibat itong mabigat na parusa sa ilalim ng Republic Act No. 10591.

Kung ang isang tao ay gumamit ng baril na hindi rehistrado o walang lisensya, maaari siyang makulong ng 12 to 40 years, depende sa sitwasyon—lalo na kung ginamit ito sa krimen tulad ng pananambang o pagpatay.

Ang paggamit ng loose firearm ay maaaring ituring na aggravating circumstance, na lalo pang nagpapabigat ng parusa.

“Hindi na kami okay… pero valid pa ba ang kasal namin?”

It is a question more people ask than you might think.

Because sometimes, everything looked right.
The wedding happened. The vows were said. The marriage began.

Or at least, it seemed that way.

In Philippine law, not every marriage that falls apart is automatically void. And not every marriage that lasted for years was necessarily valid from the start.

A Declaration of Nullity of Marriage does not focus on what happened after. It looks back to the beginning and asks whether something essential was already missing when the marriage was celebrated.

Psychological incapacity, for example, is often misunderstood. It is not about ordinary conflict or growing apart. The law requires a condition that is serious, deeply rooted, and already existing at the time of the marriage, supported by evidence.

This is why two people can share the same wedding…
but have very different legal realities.

The wedding.
The marriage.
Not always the same.

And sometimes, clarity begins by understanding that difference.

“Attorney, naka-receive po ako ng Subpoena galing sa Prosecutor’s Office. Makukulong na po ba ako?”

Hindi po. Huwag agad matakot.

Kapag nakatanggap ka ng subpoena mula sa Office of the Prosecutor, hindi pa ito nangangahulugan na may kaso ka na sa korte, at lalong hindi ibig sabihin na makukulong ka na.

Ang ibig sabihin lang nito ay may isinampang reklamo laban sa iyo, at ikaw ay binibigyan ng pagkakataon na magpaliwanag.

Ito ang tinatawag na Preliminary Investigation.

Sa yugtong ito:

• Iniimbestigahan pa lang kung may sapat na ebidensya laban sa iyo
• Bibigyan ka ng pagkakataon na mag submit ng Counter-Affidavit
• Dito mo ilalahad ang side mo at mga ebidensya mo
• Hindi pa ito trial, at walang pagdedesisyon ng guilt or innocence

Ang tinitingnan pa lang ng Prosecutor ay kung may tinatawag na prima facie evidence with reasonable certainty of conviction o sapat na basehan para dalhin ang kaso sa korte.

Dalawa lang ang pwedeng mangyari pagkatapos ng preliminary investigation:

Dismissed ang reklamo – walang sapat na ebidensya
I-file ang kaso sa korte – dito pa lang magsisimula ang tunay na kaso

Kaya mahalagang tandaan:

➡️ Ang subpoena ay hindi pa hatol
➡️ Hindi pa ito warrant of arrest
➡️ May pagkakataon ka pang depensahan ang sarili mo

Sa totoo lang, ito ang isa sa pinakamahalagang stage — dahil kung maayos ang depensa mo dito pa lang, posible nang hindi na umabot sa korte ang kaso.

Kung nakatanggap ka ng Subpeena, huwag mo itong balewalain. Mas mabuting kumilos agad, kumonsulta, at ihanda ang iyong sagot.
