Sa pamamagitan ng kaukulang Panlalawigang Kapasyahan, layunin ng deklarasyon na mapabilis ang pagtugon ng pamahalaan sa pangangailangan ng mga Bulakenyong naapektuhan ng kalamidad, kabilang ang agarang pagbibigay ng relief assistance, food and non-food items, medical assistance, rehabilitation at iba pang kinakailangang serbisyo.

Inaasahan ding magsisilbing daan ang deklarasyon upang mas mabilis na maisakatuparan ang mga hakbang para sa rehabilitasyon at pagbangon ng mga komunidad, gayundin ang pagpapatupad ng mga mekanismo upang maprotektahan ang publiko laban sa hindi makatarungang pagtaas ng presyo ng mga pangunahing bilihin at iba pang pangangailangan.

Sa harap ng panibagong hamon, nananatiling nakatuon ang pamahalaan sa kaligtasan, kapakanan ng bawat Bulakenyo.

A famous trademark does not lose its legal protection simply because it is placed on a different kind of product.

In ISCO Holding Corporation v. Nikon Corporation, G.R. No. 256002, November 17, 2025, the Supreme Court ruled that the protection of a registered well-known mark may extend beyond the goods or services for which it became known.

The decisive question was not merely whether household products compete with cameras. What mattered was whether the use of “NIKON” could lead the public to believe that the products were connected with, authorized by, or endorsed by Nikon Corporation. Because the word itself remained the dominant and recognizable feature of the proposed mark, differences in lettering or design could not erase that likely association.

The ruling offers a practical reminder for business owners: adopting a well-known name for unrelated goods is not a safe shortcut. Trademark law protects not only against direct consumer confusion, but also against conduct that weakens the identity and commercial value of a famous mark.

A brand should therefore be built on originality, not on the reputation another business spent years earning.

In Republic of the Philippines v. Ramoran-Wong and Wong, G.R. No. 276986, February 3, 2026, the Supreme Court clarified that the spouses’ mutual desire to have their marriage declared void does not, by itself, constitute collusion.

Collusion refers to a secret agreement or cooperation, typically for an illegal or deceitful purpose, such as a scheme to defraud or obtain something prohibited by law or, in annulment cases, to secure a favorable judgment. A spouse’s decision not to oppose a petition, or both spouses’ honest recognition that their marriage was fundamentally defective from the beginning, is not automatically proof of collusion.

A declaration of nullity is not divorce but a judicial recognition that an essential requirement for a valid marriage was absent from the beginning, thereby upholding the integrity of judicial proceedings while ensuring that the law does not confine individuals to a fundamentally defective union marked by violence, abandonment, addiction, or continuing suffering.

CONSPIRACY

Conspiracy exists when two or more persons agree to commit an unlawful act and act toward accomplishing their common purpose.

Once conspiracy is proven, the law treats the act of one conspirator as the act of all. Each conspirator may therefore be held liable as a co-principal, even if their individual roles or degrees of participation differ.

What matters is the existence of a common criminal design: although the conspirators may perform separate acts, their actions must contribute to the same unlawful result.

The Supreme Court held that a person who knowingly pretends to own real property and, through such misrepresentation, induces another to pay for it may be held criminally liable for estafa by deceit under Article 315(2)(a) of the Revised Penal Code.

Deceit may consist of false statements, misleading conduct, concealment, or the suppression of facts that should have been disclosed. When the false representation is made before or during the transaction, relied upon by the offended party, and results in financial loss, criminal liability may arise.

The Court further clarified that the offended party’s failure to exercise sufficient due diligence does not erase the fraud committed. Likewise, the transaction is not rendered purely civil when deceit was employed from the beginning as the means of obtaining the money. (G.R. No. 215132, September 13, 2021)
