The (SC) ๐˜Œ๐˜ฏ ๐˜‰๐˜ข๐˜ฏ๐˜ค, during its session today, April 29, 2026, dismissed the petition for mandamus filed by Catalino Aldea Generillo, Jr., which sought to compel the Senate to immediately convene as an impeachment court to try the charges against Vice President Sara Duterte.

In a 14-0-1 Decision written by Associate Justice Rodil V. Zalameda, the SC held that mandamus, which is meant to enforce a clear legal duty, was not the proper remedy. It ruled that the Senateโ€™s actions within its sphere cannot be revised or controlled by the judicial department through mandamus. As a co-equal constitutional body, the Senateโ€™s exercise of its duties is beyond the SCโ€™s power of review, except in cases of grave abuse of discretion.

However, specifically for this case and in the interest of equity, the SC treated the petition as one for certiorari and proceeded to determine whether the Senate acted unlawfully or abused its discretion when it did not convene immediately as an impeachment court during its session break.

Contrary to the petitionerโ€™s claim, the SC found that the Senate acted on the impeachment complaint in a timely manner.

While the Constitution requires the House of Representatives to act within a certain number of session days on an impeachment complaint, it does not specify a fixed timeframe for the Senate to start an impeachment trial. It simply provides that the trial โ€œshall forthwith proceed,โ€ leaving the timing to the Senateโ€™s discretion.

The SC clarified that the term โ€œforthwithโ€ in Article XI, Section 3(4) of the Constitution means within a reasonable time, which may be longer or shorter, depending on the circumstances of each case. This allows the Senate to make the necessary preparations to convene as an impeachment court.

While the Constitution does not set an exact date for the trial, the Senate must avoid undue delay to uphold the principle that public officers must at all times be accountable to the people.

The SC considered the petition moot because the Senate had begun impeachment preparations, and the Articles of Impeachment against Vice President Duterte were nullified by the SCโ€™s July 25, 2025 Decision and January 28, 2026 Resolution in Duterte v. House of Representatives. A case is moot when subsequent events remove any issues, making court rulings unnecessary. Since no Articles of Impeachment remained, the SC had no reason to order the Senate to convene as an impeachment court.

Senior Associate Justice Marvic M.V.F. Leonen concurred only in the result, that the petition was moot. However he was of the position that the impeachment court should have been convened immediately and that the impeachment courtโ€”not merely the Senate Presidentโ€”should have taken charge of organizing that court. The SupremeCourtPH (SC) has clarified that a complaint or petition may only be dismissed for failure to state a cause of action after an examination of the complaint or information itself, together with its annexesโ€”strictly excluding the pleadings or submissions of other parties, reconciling conflicting rulings on the issue.

In a Decision written by Associate Justice Maria Filomena D. Singh, the SCโ€™s Third Division ruled that the lower courts erred in dismissing a petition for quieting of title for supposedly failing to state a cause of action and in interchanging this concept with โ€œdismissal for lack of cause of action.โ€

A cause of action is the act or omission by which a party violates a right of another, the three elements of which are:

1. a right in favor of the plaintiff by whatever means and under whatever law it arises or is created;

2. an obligation on the part of the named defendant to respect or not to violate such right; and

3. an act or omission on the part of the named defendant violative of the right of the plaintiff or constituting a breach of the obligation of defendant to the plaintiff which the latter may maintain an action for recovery of damages.

The case arose from a land dispute between the groups of Inocencio Taganile and Filomena Delos Santos Dolar.

Taganileโ€™s group claims that it has occupied a portion of land along Dr. Sixto Antonio Avenue in Rosario, Pasig City, since 1970. After learning that the land had been registered in the name of Dolarโ€™s group, they filed a petition before the Regional Trial Court (RTC) to challenge the title.

Dolarโ€™s group, on the other hand, claims that Taganileโ€™s group were mere lessees. They filed a motion to dismiss the petition, arguing that it did not state a cause of action because it lacked supporting documents.

The RTC dismissed the case after considering both the petition and the evidence presented by Dolarโ€™s group. It ruled that the petition failed to state a cause of action because it did not include proof of the Taganileโ€™s groupโ€™s claim to the land. The Court of Appeals (CA) affirmed this ruling.

The SC disagreed. It clarified the difference between failure to state a cause of action and lack of cause of action.

A cause of action exists when a legal right is violated. Courts cannot hear a civil case unless there is a cause of action. A case may be dismissed if the complaint does not state one, or if the party later fails to prove it with evidence. These are different grounds.

To determine whether a complaint fails to state a cause of action, the court looks only at what is written in the complaint and assumes the allegations are true. If, even assuming those facts are true, the court still cannot grant the relief asked for, it can dismiss the complaint on this ground.

In contrast, to determine whether a case lacks a cause of action, the court looks at the evidence presented.

The SC noted that confusion arose from past rulings that allowed courts, in some instances, to look beyond the complaint, such as when the allegations appear to be legally impossible or unfounded. This blurred the difference between failure to state a cause of action and lack of cause of action.

To settle the issue, the SC ruled that courts may dismiss a complaint for failure to state a cause of action only by examining the complaint and its attachmentsโ€”nothing more. Courts must not consider other pleadings or submissions at this stage.

The SC explained:

โ€œOnce the trial court considers other pleadings submitted by the parties or evidence admitted during the proceedings, it is no longer determining a failure to state a cause of action, but rather the very existence of one. In doing so, the ground for dismissing the complaint or petition ceases to be โ€˜failure to state a cause of actionโ€™ and becomes โ€˜lack of cause of action.โ€™โ€

Applying this rule, the SC found that the RTC and CA improperly relied on the submissions and evidence of Dolarโ€™s group. They prematurely ruled on the existence of a cause of action without giving Taganileโ€™s group the chance to present evidence.

The SC also found that, based on the allegations alone, the petition was able to establish a case for quieting of title, noting Taganile groupโ€™s claims of long-standing possession and houses built on the property since the 1970s.

The SC directed that the case be returned to the RTC to continue the proceedings and receive evidence on the partiesโ€™ claims.

Pinagsabihan ng si Marikina City Regional Trial Court (RTC) Judge Rey P. Inciong (Judge Inciong) dahil sa kanyang asal laban kay Atty. Ivanheck U. Gatdula, isang abogado ng Public Attorneyโ€™s Office (PAO), sa isang insidenteng may kinalaman sa pagparada ng sasakyan na ibinahagi sa social media.

Sa Desisyon na isinulat ni Associate Justice Jhosep Y. Lopez, sinabi ng En Banc ng Korte Suprema na kumilos nang hindi wasto si Judge Inciong nang sawayin niya sa publiko ang abogado ng PAO na si Atty. Gatdula at hilingin ang isang pampublikong paumanhin.

Nagbitaw si Judge Inciong ng mga mapanlait na pahayag laban kay Atty. Gatdula matapos pansamantalang iparada ng abogado ang kanyang sasakyan, na nakaharang sa isang access ramp para sa mga person with disabilities (PWD) at sa daanan ng mga naglalakad habang siya ay nagla-log ng kanyang attendance para hindi ma-markahang late. Agad namang humingi ng paumanhin si Atty. Gatdula nang ilang ulit.

Sa kabila nito, iginiit ni Judge Inciong na humingi si Atty. Gatdula ng isang pampublikong paumanhin. Kalaunan, nagtungo pa ang hukom sa tanggapan ng PAO kung saan muli niyang iginiit ang paghingi ng paumanhin at hindi na nakapagpigil sa sarili.

Inatasan ng Office of the Court Administrator si Judge Inciong na magpaliwanag sa kanyang mga ikinilos at nagrekomendang pagsabihan at mahigpit na balaan ang hukom.

Idinulog ang kaso sa Judicial Integrity Board na nagrekomendang napatunayang nagkasala si Judge Inciong sa light offense of vulgar and unbecoming conduct sa ilalim ng Canon VI, Section 35(b) ng Code of Professional Responsibility and Accountability (CPRA).

Sa pagpuna kay Judge Inciong, kinilala ng Korte Suprema ang kanyang layuning mapanatili ang kaayusan sa loob ng hall of justice pero binigyang-diin nito na hindi tama ang paggamit ng marahas na pananalita o agresibong asal.

Sa pagbanggit sa Canon II (Integridad) at Canon IV (Kahusayan sa Asal) ng CPRA, pinaalalahanan ng Korte Suprema ang mga hukom na kahit nahaharap sa hindi wastong asal, nararapat pa rin silang kumilos nang may pagpipigil sa sarili at panatilihin ang dignidad ng kanilang tungkulin. Dagdag pa nito, nakasalalay sa asal ng mga hukom ang tiwala ng publiko sa Hudikatura.

Sinabi rin ng Korte Suprema na maaaring gamitin ng mga hukom ang kanilang karapatan sa malayang pananalita at pagpapahayag pero dapat itong gawin sa loob ng hangganan ng kagandahang-asal.

Binigyang-pansin ng Korte Suprema na unang paglabag ito ni Judge Inciong at may malinis siyang rekord sa serbisyo publiko mula pa noong 1999. Bagamaโ€™t itinuring siyang malaya sa pananagutang administratibo, nagbigay ang Korte ng babala na mapapatawan ng mas mabigat na parusa ang mga kahalintulad na asal sa hinaharap.
