Supreme Court increases the threshold amount of small claims cases to ₱1,000,000.00

The Supreme Court, during its En Banc deliberation on Tuesday, March 1, 2022, approved the procedural rules expediting criminal and civil actions filed before the first level courts which effectively amended the 2016 Revised Rules on Small Claims Cases.

The Rules increases the threshold amount of small claims cases to ₱1,000,000.00 and no longer makes a distinction whether the claim is filed before the first level courts within or outside Metro Manila. The claim or demand may be for money owed under contracts of lease, loan and other credit accommodations, services, and sale of personal property. The recovery of personal property is excluded, unless made subject of a compromise agreement between the parties. Nevertheless, the enforcement of barangay amicable settlement agreements and arbitration awards where the money claim does not exceed ₱1,000,000.00 is likewise covered.

Doctrines in Criminal Law: Capacity to act under civil law cannot be equated to capacity to give sexual consent for individuals between 12 years old and below 18 years of age.

Facts of the Case: The Information alleges that sometime in the month of January 2012, the accused, with intent to abuse, harass and degrade AAA, a twelve (12) year old minor at that time, and gratify the sexual desire of said accused, the latter did then and there, willfully, unlawfully and feloniously, had sexual in*******se with said AAA, in her dwelling against her will and consent.
In his defense, accused argued that that he is in a relationship with AAA and that the act complained of was consensual. Accused further maintained that their persisting relationship should be taken into account and be considered an absolutory cause. While there is no valid marriage to speak of yet, they were clearly living together as husband and wife as evidenced by the birth of their second child.

Issue: May the accused use as a defense the consent of AAA and his on-going relationship with her which had already produced two children to exonerate himself from the charge of violation of Section 5(b), Article III of-R.A. 7610?

Held: Yes. Section 5(b) of R.A 7610 only punishes sexual in*******se or lascivious conduct not only with a child exploited in prostitution but also with a child subjected to other sexual abuse. However, the law is noticeably silent with respect to situations where a child is between 12 years old and below 18 years of age and engages in sexual in*******se not -'for money, profit, or any other consideration or due to the coercion or influence of any adult, syndicate or group. Thus, an individual who engages in sexual in*******se with a child, at least 12 and under 18 years of age, and not falling under any of these circumstances [referring to sexual in*******se or lascivious conduct with a child for money, profit, or any other consideration or due to the coercion or influence of any adult, syndicate or group] cannot be held liable under the provisions of R.A. 7610. The interpretation that consent is material in cases where victim is between 12 years old and below 18 years of age is favorable to the accused.

Supreme Court further rectifies the difference between the concept of consent under contract law and sexual consent in criminal law which determines the guilt of an individual engaging in a sexual relationship with one who is between 12 years old or below 18 years of age. Capacity to act under civil law cannot be equated to capacity to give sexual consent for individuals between 12 years old and below 18 years of age. Sexual consent does not involve any obligation within the context of civil law and instead refers to a private act or sexual activity that may be covered by the Revised Penal Code and R.A. 7610.

Three-Term Limit Rule vis-a-vis Assumption of Office by Operation of Law

Facts: JTC was elected vice-mayor of Pateros on May 10, 2004 for a term ending June 30, 2007. On September 2, 2004, JTC became mayor, by operation of law, upon the death of the incumbent mayor, CB. JTC was then elected and served as mayor for terms 2007-2010 and 2010-2013. When JTC expressed his intention to run again for the mayoralty position during the 2013 elections, BUB, who was then also a candidate for mayor, sought JTC’s disqualification for violation of the three-term limit rule.

Issue: Can JTC run again for mayoralty position in the 2013 election?

Held: Yes. For the disqualification rule to apply, it is not enough that an individual has served three consecutive terms in an elective local office, he must also have been elected to the same position for the same number of times before the disqualification can apply. In this case, there was no violation of the three-term limit, for JTC was not elected to the office of the mayor in the first term but simply found himself thrust into it by operation of law when a permanent vacancy occurred in that office.
