The (SC) has ruled that a spouse’s inability to love or emotionally connect with their partner, if rooted in a genuine personality disorder, may be considered evidence of psychological incapacity and a ground to declare a marriage void.

In a Decision written by Senior Associate Justice Marvic M.V.F. Leonen, the SC’s Second Division reinstated an earlier ruling of the Regional Trial Court (RTC) which declared a couple’s marriage void from the beginning due to the husband’s psychological incapacity to fulfill his marital duties.

The couple met in 1999 and married in 2002. They did not live together immediately, as the husband worked in Saudi Arabia. They were only physically together for about five years, and their relationship was marked by frequent arguments and periods of separation.

In 2016, the husband filed a petition to nullify the marriage, supported by a psychologist’s diagnosis of his Passive-Aggressive Personality Disorder, which made it difficult for him to maintain close relationships. The RTC initially granted his petition, but reversed the same on reconsideration. The Court of Appeals denied the husband’s appeal.

The SC, however, ruled in favor of the husband, finding that he had sufficiently proven psychological incapacity.

Under Article 36 of the Family Code, a marriage is void if one or both spouses are psychologically unable to fulfill their marital duties—even if the condition becomes evident only after the wedding. The incapacity must be deeply rooted in the person’s character and must have existed before the marriage.

The SC clarified that psychological incapacity can manifest long after the wedding, so a spouse who initially appears capable may later show signs of inability. If this comes from a genuine psychological condition, the marriage can still be declared void.

In this case, the SC found that the husband’s emotional detachment stemmed from a strict and emotionally distant upbringing. While he could provide for his family financially, he struggled to meet his wife’s emotional needs, including basic companionship.

Muling iginiit ng na nananatiling lehitimo ang mga anak kahit na ang kasal ng kanilang mga magulang ay idineklarang walang bisa dahil sa psychological incapacity.

Sa Desisyon na isinulat ni Associate Justice Jhosep Y. Lopez, binago ng Second Division ng Korte ang desisyon ng Regional Trial Court na nagdeklarang illegitimate ang isang anak kasunod ng pagpapawalang-bisa ng kasal ng kanyang mga magulang.

Ipinanganak ang bata ilang buwan bago ikinasal ang mag-asawa. Sa panahon ng kasal, ang asawang babae ay nakaranas ng pisikal, emosyonal, at berbal na pang-aabuso mula sa kanyang asawa. Ang asawang lalaki ay may isyu din ng pagkalulong sa alak, pagsusugal, at pagtataksil.

Sa petisyon na isinampa ng babae para mapawalang-bisa ang kanilang kasal, nagprisinta siya ng mga ebidensya ng pang-aabuso at isang sikolohikal na ulat na nag-diagnose sa kanyang asawa na may narcissistic personality disorder.

Pinagtibay ng Korte Suprema ang desisyon ng Regional Trial Court na walang bisa ang kasal pero nagpasya din ito na ang bata ay nananatiling lehitimo. Sa pangkalahatan, kapag ang isang kasal ay pinawalang-bisa, ang anak ay itinuturing na hindi lehitimo mula sa oras na sila ay ipinaglihi. Gayunpaman, may exception sa Family Code tulad ng kapag ang kasal ay pinawalang-bisa dahil sa psychological incapacity. Nalalapat ito kung ang bata ay ipinanganak bago o habang kasal.

Dagdag pa ng Korte, ang nawawalang anotasyon sa birth certificate ay hindi nakakaapekto sa legal na kalagayan ng anak.

Kapag naging lehitimo ang isang anak sa ilalim ng Family Code, walang legal na basehan para baguhin ang kanilang status pabalik sa illegitimate. Ang pagpayag dito ay labag sa layunin ng batas na protektahan ang best interest ng anak.

NON-APPEARANCE in the Annulment process is NOT allowed under the Family Code of the Philippines.

By law, an annulment is a judicial proceeding that requires the active participation of the parties, especially the petitioner (the person filing the annulment).

Here are the Important points:

1. Judicial Process of Annulment

Annulment cannot be done by mere document or proxy. According to the law, it must go through the proper process in court, and the petitioner must provide testimony to prove the reasons for annulment stated in the Family Code.

2. It's not possible for Non-Appearance

Physical attendance at hearings is essential. Personal testimony is required from the petitioner to support the issues presented to the court. In most cases, failure to attend may result in dismissal of the case.

3. OFWs and Special Considerations

Although physical presence is difficult for OFWs, a motion can be filed to use videoconferencing if the court allows. There are some courts that provide this option, especially if there is a strong valid reason can be proven.

4. Beware of Those Who Offer Non-Appearance Services

People who offer “non-appearance annulment” are often fixers or doing illegal transactions.

Matagal na pagliban ng asawa, maituturing na Psychological Incapacity ayon sa Korte Suprema

Ang matagal ng pagkawala ng asawa sa kanilang pamamahay ay maaring ituring na katibayan ng psychological incapacity na basehan para ipawalang-bisa ang kasal.

Sa Desisyon na isinulat ni Senior Associate Justice Marvic M.V.F. Leonen, pinawalang-bisa ng Korte Suprema ang kasal nina Leonora at Alfredo matapos mapatunayan na tumanggi si Alfredo na magbigay ng pinansyal na suporta sa kanyang pamilya at tuluyang iniwan si Leonora at kanilang mga anak simula 1994.

Napatunayan ding nagkaroon ng relasyon si Alfredo sa ibang mga babae.

Ayon sa Korte Suprema, nakasaad sa Article 68 ng Family Code na obligasyon ng mag-asawa na magsama, magpakita ng pag-ibig, respeto, at katapatan sa isa't isa, at magbigay ng tulong at suporta.

Ang pangangaliwa ni Alfredo, ang kanyang matagal na pagkawala sa tahanan at ang hindi pagbibigay ng suporta sa kanyang misis at anak ay nagpapakita na hindi nya naiintindihan ang kanyang mga obligasyon bilang asawa at ama.

YES. Matutuloy ang Annulment Case kahit walang permiso,walang pirma o Absent ang sinampahang asawa ng kaso.Ang mahalaga ay merong ground ang nag sampang asawa at napatunayan ito ng kanyang ebidensya sa korte.
Ang mahalaga lamang sa proseso ng annulment of marriage ay mapadalhan ng “Summons” ang isang order ng korte kung saan inuutusan ang sinampahang asawa na sagutin ang mga paratang sa kanya sa loob ng 10 days mula sa pagkatanggap ng summons,kung ang summons ng korte ay hindi mapadala sa sinampahang asawa dahil hindi sya ma locate sa kanyang address o siya ay nasa abroad o ang kanyang kinaroroonan ay hindi alam ng nagsampang asawa, ang service of summons ay pwedeng gawin sa pamamagitan ng pag publish ng petition at ng summons sa once a week for two consecutive weeks in a newspaper of general circulation in the Philippines, and in such places as the court may order. At kasama dito ang pagpapadala sa sinampahang asawa at his/her last known address by registered mail.Pagkatapos ma i publish ang petition at summons sa newspaper ay pwede na mag diretso ang proseso ng annulment kahit wala o absent ang sinampahang asawa.

“PARA SA MGA NASA ABROAD”
TANONG: “Balak ko po mag file ng annulment of marriage pero nasa abroad ako,kailangan ba nasa hearing ako sa Pilipinas at ilang months ba ang required na nasa Pilipinas ako o days lamang ba. Please enlighten me Atty para masimulan ko na po?"

SAGOT: Ang annulment of marriage at declaration of nullity of marriage ay isang proseso sa korte kung saan required na magpakita o mag-appear ang taong nagsampa nito o ang petitioner at magpresenta ng evidence niya sa harap ng korte sa kanyang hearing.

Art. 48. In all cases of annulment or declaration of absolute nullity of marriage, the Court shall order the prosecuting attorney or fiscal assigned to it to appear on behalf of the State to take steps to prevent collusion between the parties and to take care that evidence is not fabricated or suppressed. In the cases referred to in the preceding paragraph, no judgment shall be based upon a stipulation of facts or confession of judgement.

Ang pagprepresenta ng petitioner o nagsampang asawa ay tinatawag na "trial proper" at pwedeng ischedule ng abogado sa kanyang vacation at hindi siya required na magtagal sa Pilipinas. Ang mahalaga ay dumating ang petitioner sa araw na tinakda ng abogado niya para sa pagpresenta niya ng evidence at pagbigay niya ng testimonya sa korte upang patunayan ang kanyang mga alegasyon sa petition for annulment of marriage. Kung natapos na siya magbigay ng testimoniya sa korte under direct examination at siya ay nacross examination na ng Fiscal/Public Prosecutor, pwede na agad siya umalis ng Pilipinas at bumalik sa bansa kung saan siya nakatira/nagtratrabaho.

Bibigyan din ng korte ng notice at pagkakataon ang iyong inihablang asawa na magpresenta ng kanyang ebidensiya. Pagkatapos nito ay, magdedesisyon na ang korte. Kung ang decision ng korte ay para sa annulment, kailangang maging final and executory ito. Mayroon 15 days ang iyong asawa, fiscal o OSG na magfile ng Motion for Reconsideration at i-apela ang desisyon sa Court of Appeals at kung hindi, magiging final and executory ito after 15 days mula sa pagtanggap ng decision ng korte.

Kailangan ba na present ang petitioner sa paglabas ng desisyon sa annulment of marriage at declaration of nullity of marriage?

Hindi. Ang desisyon ay pinapadala ng korte sa pamamagitan ng postal office sa address ng petitioner at hindi na kailangan ang presensiya niya sa Pilipinas. Kailangan lamang na ito ay mareceive ng petitioner's counsel upang maging final ito pagkatapos ng 15 days mula sa pagkareceive ng OSG at respondent ng desisyon.
