For many small and growing businesses, employment concerns can be challenging to navigate. In some cases, employees may even request that their SSS, PhilHealth, or Pag-IBIG contributions not be deducted so they can take home a larger amount each payday.

While such requests may be made in good faith, an employer's obligation to register employees and remit the required contributions does not depend on the employee's consent. These contributions are generally mandated by law and cannot simply be waived by agreement between the employer and employee.

Failure to comply with these requirements may expose the employer to penalties and other liabilities.

It’s easy to lend money, but often much harder to collect it.

Many people know the frustration of being owed money by someone who refuses to pay. It is a situation that can be stressful, disappointing, and, at times, infuriating. Understandably, some creditors ask whether a person who refuses to pay a debt can be sent to jail.

As a general rule, the answer is no. Under Philippine law, a person cannot be imprisoned simply for failing to pay a debt. A criminal case may arise only if the debt was obtained through fraud or deceit (or if a bounced check is involved). Otherwise, the proper remedy is usually a civil case for the collection of the amount owed.

Of course, prevention is often better than cure. Before lending money, consider putting the terms of the loan in writing. A clear written agreement can help protect both parties and avoid misunderstandings later on.

This is one of the most common misconceptions about annulment.

Perhaps it comes from television shows or movies where couples sign documents to end a marriage. In the Philippines, however, divorce is generally not available, and there is no such thing as signing "annulment papers."

An annulment is a court proceeding. The court does not decide the case based on whether the spouses agree, but on whether legal grounds exist under the Family Code and whether those grounds are supported by evidence.

In fact, a collusion investigation takes place before a case for annulment proceeds to ensure that the parties did not simply agree to end the marriage and fabricate grounds for annulment. Ultimately, it is the court that evaluates the evidence and decides whether the marriage should be declared void or annulled.
