Ang Extra Judicial Settlement (EJS) ay paraan ng pag-aayos ng naiwan na ari-arian ng isang namatay nang hindi dumadaan sa full court proceedings.

Karaniwan itong pinag-uusapan kapag may namatay na may naiwan na property, at kailangang mailipat o mahati ito sa mga heirs.

Pero hindi ito automatic na pwede sa lahat ng sitwasyon.

Mahalagang tingnan muna kung may last will, may utang ang estate, sino-sino ang heirs, kung lahat ba ay willing pumirma, at kung kumpleto ang documents ng property.

Bago gumawa o pumirma ng extrajudicial settlement, makakatulong na kumonsulta sa abogado para malaman kung ito ang tamang proseso para sa inyong sitwasyon.

Unang-una, ayusin at i-save ang ebidensya.

Ipunin ang proof of payment, receipts, bank transfers, GCash or Maya transactions, messages, contracts, brochures, social media posts, screenshots, names ng mga nakausap, at timeline ng mga pangyayari.

Huwag muna burahin ang chats or posts, kahit nakakainis o nakakahiya. Maaaring makatulong ang mga ito para maipakita kung ano ang ipinangako, sino ang nanghikayat, magkano ang naibayad, at ano ang nangyari pagkatapos.

Mahalaga ring malaman kung ilan ang involved, kung marami ang nabiktima, at kung paano nakuha ang pera. Depende sa facts, maaaring pumasok ang usapin sa estafa, syndicated estafa, civil case, o ibang legal remedy.

Bago gumawa ng legal step, makakatulong na kumonsulta sa abogado para malaman kung anong kaso ang angkop at paano maihahanda nang maayos ang complaint.

Hindi porket magkasama pa rin kayo sa bahay, ibig sabihin wala ka nang pwedeng gawin.

May mga mag-asawa na magkasama pa rin sa iisang bahay dahil sa anak, gastusin, tirahan, trabaho, o dahil wala pa silang ibang maayos na arrangement.

Pero hindi rin ibig sabihin na automatic may case na agad.

Kailangan pa ring tingnan kung ano ang nangyari sa pagsasama, kailan nagsimula ang problema, gaano ito kaseryoso, at kung may legal ground na pwedeng gamitin.

Mahalaga rin na totoo at malinaw ang ikukuwento. Hindi kailangang pilitin ang facts para lang makapag-file.

Makakatulong na kumonsulta sa abogado para malaman kung may basis ang case at kung ano ang tamang option para sa sitwasyon mo.

Kahit pareho kayong pumapayag na maghiwalay, hindi ninyo basta-basta matatapos ang kasal sa pamamagitan lang ng written agreement.

Sa Pilipinas, kailangan pa rin dumaan sa tamang legal na proseso. Depende sa sitwasyon, maaaring ang remedy ay annulment, declaration of nullity of marriage, o legal separation.

Mahalaga ring tandaan na magkakaiba ang epekto ng bawat remedy. May proseso na maaaring makaapekto sa civil status, property, custody, support, at karapatang magpakasal ulit.

Bago pumirma ng anumang kasunduan, makakatulong na kumonsulta muna sa abogado para malaman kung ano ang tamang legal option para sa inyong sitwasyon.
