Nagpasya ang na maituturing na constructive dismissal ang pagpapatupad ng bawas na araw sa pagtatrabaho at sistema ng rotasyon kung walang pagpayag mula sa mga manggagawa.

Sa Desisyon na isinulat ni Associate Justice Amy C. Lazaro-Javier, sinabi En Banc ng Korte Suprema na may pananagutan ang Fiber Textile Manufacturing Corp. (FMC), isang kumpanya ng pagawaan ng tela, sa constructive dismissal ng pito nitong manggagawa sa produksiyon. Ito ay matapos bawasan ng kumpanya ang kanilang anim na araw na workweek tungo sa dalawa hanggang tatlong araw na lamang at magpatupad ng plano para sa rotasyon sa trabaho nang walang pahintulot ng mga manggagawa. Giit ng FMC, sumang-ayon ang mga manggagawa sa pansamantalang sistema na ito sa isang pagpupulong ukol sa kakulangan ng mga raw material o hilaw na materyales.

Naghain ng reklamo para sa constructive dismissal ang mga manggagawa at iginiit na mistula silang tinanggal sa trabaho nang sabihan silang huwag nang bumalik sa trabaho.

Nagpasya ang Labor Arbiter pabor sa mga manggagawa pero binaliktad ito ng National Labor Relations Commission (NLRC) at ng Court of Appeals (CA) na kinatigan ang mga naging hakbang ng FMC bilang wastong paggamit ng management prerogative.

Hindi sumang-ayon ang Korte Suprema. Binigyang-diin nito na bagamat maaaring magpatupad ang mga employer ng mga flexible work arrangement sa panahon ng kagipitang pang-ekonomiya o mga national emergency, dapat sumunod ang mga kaayusang ito sa mga itinakda sa Department Advisory No. 2, Series of 2009 ng Department of Labor and Employment (DOLE).

Paliwanag ng Korte Suprema, dapat munang konsultahin ng mga employer ang mga apektadong empleyado at makuha ang kusang-loob na suporta ng mayorya ng mga manggagawa. Dapat din ipagbigay-alam ng mga employer sa DOLE bago ipatupad ang kaayusan, at patunayan na ang kumpanya ay nakararanas ng tunay o makatwirang nagbabadyang kagipitang pang-ekonomiya.

Sa kasong ito, sinabi ng Korte Suprema na nabigo ang FMC na patunayan na kusang-loob na sumang-ayon ang mga manggagawa sa bawas na mga araw ng pagtatrabaho at sa sistema ng rotasyon. Nagpasya ang Korte na hindi katumbas ng pagkuha sa kanilang pahintulot ang simpleng pagpapatalastas o pagbibigay-alam sa mga empleyado ukol sa kaayusan.

Nabigo rin ang FMC na mag-abiso sa DOLE bago ang pagpapatupad nito at nabigong patunayan na ito ay nakararanas ng tunay o nagbabadyang kagipitang pang-ekonomiya na magbibigay-katwiran sa pagbabawas ng mga araw ng pagtatrabaho.

Binigyang-diin din ng Korte na bagamat maaaring magpatupad ang mga employer ng mga flexible work arrangement para maiwasan ang pagkalugi ng negosyo, ang mga naturang hakbang ay dapat gawin nang may good faith o mabuting intensiyon at may wastong pagpapahalaga sa mga karapatan ng mga manggagawa.

Ang ilegal na pagbabawas ng FMC sa mga araw ng pagtatrabaho ay maituturing na constructive dismissal dahil nagresulta ito sa pagbaba ng suweldo na naging hindi makatwiran para sa mga manggagawa ang pananatili sa trabaho.

Sa kanyang Sumasang-ayon na Opinyon, binigyang-diin ni Senior Associate Justice Marvic M.V.F. Leonen na ang kinakailangang mutual consent o pahintulot sa parehong panig sa mga flexible work arrangement ay nag-uugat sa consensual nature ng mga kontrata sa trabaho kung kaya’t hindi maaaring baguhin ng mga employer nang mag-isa ang mga iskedyul sa paraang magbabawas sa suweldo ng mga empleyado.

Sa kanyang Sumasang-ayon at Hindi Sumasang-ayon na Opinyon, sumang-ayon si Associate Justice Alfredo Benjamin S. Caguioa na nananatiling may pananagutan ang FMC sa constructive dismissal dahil sa kabiguan nitong patunayan na kusang-loob na sumang-ayon ang mga manggagawa sa bawas na araw ng pagtatrabaho at plano ng rotasyon. Gayunpaman, binigyang-diin niya na walang materyales ang FMC na magagamit sa loob ng ilang buwan na lubhang nakaapekto sa operasyon ng produksiyon. Dahil dito, isinaad niya na hinarap ng FMC ang isang makatwirang nagbabadyang kagipitang pang-ekonomiya na maaaring magbigay-katwiran sa pansamantalang pagpapatupad ng mga flexible work arrangement.
