Hindi puwedeng pilitin ang manggagawa na gumamit ng device o magpatuloy sa trabaho kung ang sitwasyon ay malinaw na delikado at may banta sa buhay, kalusugan, o kaligtasan.
Sa ilalim ng batas, obligasyon ng employer na magbigay ng workplace na walang hazardous conditions na maaaring magdulot ng kamatayan, sakit, o pisikal na pinsala. May karapatan din ang manggagawa na tumanggi sa unsafe work kapag may imminent danger at wala pang sapat na aksyon para alisin ang panganib.
Kung lalabag ang kompanya sa occupational safety and health standards, maaari silang ireklamo at maaari silang managot sa ilalim ng batas. May kapangyarihan din ang DOLE na magpatigil ng trabaho o magsuspinde ng operasyon kapag ang paglabag ay naglalagay ng grave and imminent danger sa health at safety ng mga manggagawa.
Kung nangyayari ito sa inyo, huwag manahimik. Dumulog kayo sa inyong Union kung meron, lalo na sa inyong union representative. Maaari rin kayong magsampa ng reklamo o Request for Assistance sa pinakamalapit na DOLE Regional, Provincial, o Field Office, o sa DOLE’s online assistance system.

RA 11058 Sec. 4 requires employers to furnish workers “a place of employment free from hazardous conditions” and to use only approved devices and equipment for the workplace. The same law also requires safety instructions, hazard information, protective devices, and first-aid arrangements.
RA 11058 Sec. 6 gives a worker the right to refuse unsafe work without threat or reprisal when an imminent danger situation exists and the employer has not yet taken corrective action. RA 11058 Sec. 7 also gives workers and their representatives the right to report hazards and dangerous occurrences to the employer, DOLE, and other concerned agencies.
RA 11058 Sec. 22, pursuant to Article 128 of the Labor Code, allows the Secretary of Labor or authorized representatives to inspect workplaces and to order stoppage of work or suspension of operations when noncompliance poses grave and imminent danger to workers’ health and safety. Sec. 23 adds that if stoppage due to imminent danger results from the employer’s violation or fault, the employer shall pay the workers concerned their wages during the stoppage or suspension.
RA 11058 Sec. 28 states that willful failure or refusal to comply with OSH standards or compliance orders may lead to an administrative fine of up to P100,000 per day until the violation is corrected; the maximum amount is imposed only when the violation exposes workers to a risk of death, serious injury, or serious illness.
RA 11058 Sec. 13 includes workers’ representatives from the union in the workplace safety and health committee if the workers are organized, and DOLE ARMS says a Request for Assistance may be filed by an aggrieved worker, a group of workers, or a union, either onsite or online.
