SC issues TRO vs. COMELEC reso allowing public appointive official to stay in office after being named party-list nominee

The Supreme Court has issued a temporary restraining order against the implementation of a COMELEC resolution which allows public appointive officials to continue holding office even after being nominated as a party-list representative.

The TRO is directed at section 11 of COMELEC Resolution No. 11045.

The Court said that all parties are required to observe the status quo that public appointive officials are deemed resigned upon filing their certificate of candidacy.

The petition was filed by election lawyer Romulo B. Macalintal.

COMELEC is required to comment on the petition within a non-extendible period of 10 days from notice.

Korte Suprema naglabas ng TRO laban sa COMELEC reso na pinapayagang manatili sa pwesto ang mga public appointive officials na pinangalanang party-list nominee

Pinapatigil ng Korte Suprema ang pagpapatupad sa isang resolusyon ng COMELEC na nagpapahintulot sa mga public appointive officials na manatili sa pwesto kahit pinangalanan na silang party-list nominee.

Naglabas ang Korte Suprema ng temporary restraining order o TRO laban sa pagpapatupad sa section 11 ng COMELEC Resolution No. 11045.

Ayon sa Korte, dapat sundin muna ng lahat ng mga partido ang status quo na ang mga public appointive officials ay itinuturing na nagbitiw sa pwesto sa oras na maghain sila ng kanilang certificate of candidacy.

Binigyan ng Korte Suprema ang COMELEC ng non-extendible na 10 araw para magsumite ng mga komento sa petisyon ni Atty. Romulo B. Macalintal.

Under COMELEC Resolution No. 11064:

All official social media accounts, pages, websites, podcasts, blogs, vlogs, and other online and internet-based campaign platforms of candidates, political parties, campaign teams, and those created or managed by any person or entity primarily designed or used to promote the election or defeat of a particular candidate(s) must be registered with the COMELEC within thirty (30) days after the filing of the Certificates of Candidacy until 13 December 2024.

Under Section 59 of COMELEC Resolution No. 11045, substitution due to the withdrawal of the original aspirant is allowed only until October 8, 2024, which is the last day for filing Certificates of Candidacy (COC). The sworn statement of withdrawal must also include the name of the substitute. Substitution is not permitted for any independent candidate. For a substitution to be valid, the substitute must file their COC and C**A with the Receiving Office.
