SC: For Online Libel, Courts May Impose Alternative Penalty of Fine Instead of Imprisonment

The Supreme Court has ruled that an accused person found guilty of online libel may be sentenced to pay a fine instead of being imprisoned. The court upheld the decision of the Regional Trial Court to convict Jomerito Soliman of online libel and impose a fine of PhP50,000. The court cited guidelines that allow for the imposition of a fine rather than imprisonment in libel cases. The People of the Philippines, represented by the Office of the Solicitor General, had petitioned for the decision to be overturned, but both the Court of Appeals and the Supreme Court affirmed the ruling.

The Supreme Court clarified that the penalty for online libel is one degree higher than that for traditional libel and that the option of imposing a fine instead of imprisonment applies to both. The court also addressed a conflict between the Cybercrime Prevention Act and its implementing rules, ruling that the penalties provided in the Revised Penal Code, as amended in 2017, should apply.

Additionally, the court emphasized that the imposition of fines in libel cases should be determined based on the circumstances of each case and the interests of justice and that imprisonment remains an alternative penalty. In Soliman's case, the court found that the circumstances surrounding the defamatory Facebook post warranted the imposition of a fine only.
