Land Disputes Among Siblings : What you need to know

Family conflicts over land often arise after the passing of parents.

Upon death, the heirs become co-owners of the estate properties before partition, subject to the decedent’s debts. No one sibling owns the entire property unless there is a proper partition.

No one can sell the whole property alone. A sibling is a co-owner and can only sell his/her share, not the entire property, without the consent of the others.

To prevent disputes and to transfer title, heirs usually execute an extrajudicial settlement/partition (or pursue judicial settlement/partition when there is disagreement).

Occupancy does not automatically make one sibling the sole owner; other heirs may demand accounting of fruits/rentals and ultimately partition. Just because one sibling is occupying the land does not mean they own it exclusively.

Fix property matters early. Clear documentation prevents conflict and preserves family relationships.
