“BUT WHAT IF IT IS TRUE?”

Truth does not automatically give a person an unrestricted right to publish damaging accusations online.

In a cyberlibel case, it may be necessary to prove not only that the statement is true, but also that it was published with good motives and for a justifiable purpose, not merely to embarrass, insult, harass, or destroy another person’s reputation.

Before posting, ask:

Is the information verified and supported by evidence?
Is there a legitimate reason to disclose it publicly?
Is the language fair and necessary, or merely intended to humiliate?
Would it be more appropriate to report the matter to the proper authorities?

Being truthful is important, but so are good faith, proper purpose, and responsible publication.

The Original Document Rule applies only when the contents/terms of the writing/recording/photo/record are the subject of inquiry, not when the issue is an external fact like existence, ex*****on, or delivery without reference to the terms.

A duplicate (including a photocopy) is admissible to the same extent as an original unless (1) authenticity of the original is genuinely in question, or (2) it’s unjust/inequitable to admit the duplicate.

If the original is a public record in custody of a public officer or recorded in a public office, contents may be proved by a certified copy.
