An adverse claim is a legal annotation stamped on the back of a Certificate of Titleโ€”whether it's an OCT or TCT. It's basically a warning sign that there's another person claiming their right or interest over that property, ๐˜ข๐˜ฅ๐˜ท๐˜ฆ๐˜ณ๐˜ด๐˜ฆ to the registered owner.

It's governed by Section 70 of Presidential Decree No. 1529, also known as the Property Registration Decree.

Think of it as a red flag planted on the title itself. Once annotated, the whole world is considered "on notice" โ€” meaning anyone who buys, lends, or transacts on that property is legally assumed to know about the claim.

โš ๏ธ ๐—ช๐—ต๐—ผ ๐—–๐—ฎ๐—ป ๐—™๐—ถ๐—น๐—ฒ ๐—œ๐˜โ€”๐—ฎ๐—ป๐—ฑ ๐—ช๐—ต๐˜†?

You can file an adverse claim if you have a legitimate interest in the property that isn't reflected in the title. Common examples:

โ†’ Unpaid sellers โ€” binenta mo na ang lupa, lumipat na ang title, pero hindi ka pa fully paid. You can annotate to prevent the buyer from reselling or mortgaging it behind your back.

โ†’ Heirs with hereditary rights โ€” may estate settlement proceedings na ongoing and the property is still under the deceased's name.

โ†’ Parties to a contract (like a Deed of Sale or Contract to Sell) where the registered owner refuses to surrender the title for proper annotation.

The key requirement: your right or interest must have arisen ๐˜ข๐˜ง๐˜ต๐˜ฆ๐˜ณ the original registration of the property. A simple money claim against the owner? That won't qualify.

๐Ÿ“ ๐—›๐—ผ๐˜„ ๐—œ๐˜€ ๐—œ๐˜ ๐——๐—ผ๐—ป๐—ฒ?

The claimant files a sworn Affidavit of Adverse Claim with the Registry of Deeds where the property is located. The affidavit must state:

โ†’ The nature of the claimed right or interest
โ†’ How and from whom it was acquired
โ†’ The certificate of title number
โ†’ The technical description of the property
โ†’ The name of the registered owner (exactly as it appears on the title)

Here's the thing: the Register of Deeds has a ๐˜ฎ๐˜ช๐˜ฏ๐˜ช๐˜ด๐˜ต๐˜ฆ๐˜ณ๐˜ช๐˜ข๐˜ญ ๐˜ฅ๐˜ถ๐˜ต๐˜บ to annotate it. Meaning, they cannot refuse or exercise discretion โ€” basta walang defect sa affidavit, iaannotate nila 'yan.

Under PD 1529, an adverse claim is effective for only 30 days from the date of registration.

But here's what a lot of people get wrong: the adverse claim does ๐˜ฏ๐˜ฐ๐˜ต automatically disappear after 30 days.

The Supreme Court has clarified that even after the 30-day period lapses, the annotation remains on the title and continues as a lien on the property ๐˜ถ๐˜ฏ๐˜ต๐˜ช๐˜ญ it is formally cancelled through a court order. Cancellation requires a verified petition and, importantly, a hearing โ€” because the adverse claimant has a right to due process.

So kung may nakita kang adverse claim sa isang title na more than 30 days old, huwag mong i-assume na "expired" na 'yan. It could still be very much alive.

If you're buying property: always check the back of the title. An annotated adverse claim means someone out there is contesting the owner's right. Kung itutuloy mo pa rin ang bilihan, you are legally considered a buyer ๐˜ธ๐˜ช๐˜ต๐˜ฉ ๐˜ฏ๐˜ฐ๐˜ต๐˜ช๐˜ค๐˜ฆ โ€” hindi ka maituturing na "innocent purchaser for value."

If you're a claimant: this is one of the most accessible and cost-effective tools to protect your property interest. But remember โ€” it is ๐˜ฏ๐˜ฐ๐˜ต a transfer of ownership. It's a protective measure, a legal flag. You still need to file the appropriate court action (reconveyance, annulment of title, specific performance, etc.) to ultimately resolve the dispute.

Filing a false or frivolous adverse claim can also get you fined โ‚ฑ1,000 to โ‚ฑ5,000 by the court. So make sure your claim is grounded in fact.

๐Ÿ’ก ๐—•๐—ผ๐˜๐˜๐—ผ๐—บ ๐—น๐—ถ๐—ป๐—ฒ: An adverse claim doesn't give you the property. But it can ๐˜€๐—ฎ๐˜ƒ๐—ฒ you from losing it while you fight for what's rightfully yours.

๐Ÿ“ŒCHAIR'S CASE: REMEDIAL LAW - Unlawful Detainer; Ex*****on Pending Appeal; Revised Rules on Summary Procedure; Grave Abuse of Discretion; Hierarchy of Courts

โญIn unlawful detainer cases, the judgment of the RTC in the exercise of its appellate jurisdiction is immediately executory, without prejudice to a further appeal. The issuance of a writ of ex*****on pending appeal is a ministerial duty of the RTC and requires no further justification or โ€œgood reasons.โ€

FACTS:
Sierra Grande filed a complaint for unlawful detainer before the MeTC of Pasay City against private respondents Elmer Tan, Nancy Tan, Bernardino Villanueva, Golden Apple Realty Corporation, and Rosvibon Realty Corporation. Sierra Grande alleged that it is the registered owner of the property located at No. 2280 Roberts Street, Pasay City, covered by TCT No. 19801, and that private respondents were occupying the property by mere tolerance.

The MeTC rendered judgment in favor of Sierra Grande and ordered private respondents and all persons claiming rights under them to immediately vacate and surrender to plaintiff the possession of the subject premises, pay attorneyโ€™s fees, and pay the cost of suit. On appeal, the RTC affirmed in toto the MeTC Decision.

Sierra Grande filed a motion for ex*****on pending appeal. Judge Ragasa denied the motion, ruling that ex*****on pending appeal is the exception to the general rule. As such an exception, the Court's discretion in allowing it must be strictly construed and firmly grounded on the existence of โ€œgood reasons.โ€ Sierra Grandeโ€™s motion for reconsideration was likewise denied.
Sierra Grande then filed a petition for certiorari directly before the Supreme Court.

ISSUES:
(1) Whether Sierra Grandeโ€™s direct resort to the Supreme Court was proper.
(2) Whether Judge Ragasa committed grave abuse of discretion in denying Sierra Grandeโ€™s motion for ex*****on pending appeal.

Sa panayam ng DZGB News sa programang 'Tingog kan Banwaan' ipinaliwanag ni Atty. Jong Bonafe na kapag sinabing probable cause, mayroong posibilidad na pinag basehan ang reklamo. Hindi ito ultimate findings of guilt, kundi isang pag-ebalwar matapos magkaroon ng sufficiency in form and substance ang mga reklamo kontra sa Bise Presidente.

Ayon kay Atty. Bonafe, kailangan magkaroon ng deklarasyon kung may posibilidad o posibleng sala na nakapaloob sa mga akusasyon kontra sa Bise Presidente.

Paglilinaw ni Atty. Bonafe na hindi ito ultimate na pagdeklara na may sala, kundi tinitingnan lamang ito base sa alegasyon sa pagdinig ng komite na pwedeng magkaroon ng trial.

โ€œIgwa nin magkakanigong basehan an reklamo kun kaya kaipohan nang isangat sa proseso. An findings kan probable cause sa mayoriya asin nagkasararong boto kan komite, ini na an magiging basehan kun magkakaigwa nin Articles of Impeachment na isusumitir sa plenaryo an nasabing mga reklamo kontra sa bise presidente. Ngunyan na igwa nan in 53 votes may magkakanigong rason para pag-ururonan ini sa plenaryo,โ€ paliwanag ng abogado.

Sa sandaling maisumite ang report, itatakda ang botohan sa plenaryo sa impeachment complaint kung saan kailangan ng 1/3 boto ng lahat ng miyembro ng Kamara para ma-impeach ang Bise Presidente at madala ang kaso sa Senado para sa trial.

๐Ÿšจ Not All Titled Lands Can Be Sold. Read this before you buy or sell one.

In the Philippines, the government gives land to qualified citizens through different programs. These lands come with official papers that prove ownership โ€” but they also come with rules you need to follow.

If somebody is offering to sell you their land, you need to know the following โ€” especially if it is in the provinces.

Here are the different kinds of awarded land:

๐Ÿ“Œ 1. Agrarian Reform Lands (from DAR)

These are farmlands given to landless farmers and tenants by the Department of Agrarian Reform (DAR).

๐ŸŒพ CLOA (Certificate of Land Ownership Award) โ€” the most common document given to farmer-beneficiaries under CARP. It covers both private and government-owned farmland.

๐ŸŒพ Emancipation Patent (EP) โ€” given to rice and corn tenant-farmers who completed the requirements under the older land reform program (PD 27).

๐ŸŒพ Order of Award (OA) โ€” a document given to qualified beneficiaries who were assigned a lot from large private estates that the government bought for redistribution.

๐ŸŒพ Collective CLOA (CCLOA) โ€” land shared by a group of farmers, meant to be divided later into individual titles per person.

๐Ÿ“Œ 2. Public Land Patents (from DENR)

These are titles given by the DENR to people who have been living on and farming government land that's been cleared for private ownership.

๐Ÿ  Homestead Patent โ€” given to citizens who lived on and farmed public land for a set number of years.

๐Ÿ  Free Patent โ€” given to Filipinos who have been occupying public farmland for at least 30 years (or since 1945).

๐Ÿ  Sales Patent โ€” given to someone who won a government land auction and farmed at least 1/5 of the land.

๐Ÿ  Special Patent โ€” given under special cases, like for certain indigenous groups, or as payment for land the government took over.

๐Ÿ  Residential Free Patent (RA 10023) โ€” for residential land that the government doesn't need for public purposes.

๐Ÿ“Œ 3. Ancestral Domains (from NCIP)

These are lands officially recognized as belonging to Indigenous Peoples under the IPRA Law of 1997.

๐Ÿ”๏ธ CADT (Certificate of Ancestral Domain Title) โ€” officially recognizes their ownership over their ancestral lands, waters, and natural resources.

๐Ÿ”๏ธ CALT (Certificate of Ancestral Land Title) โ€” recognizes a specific piece of land owned by an individual, family, or clan within the ancestral domain.

โš ๏ธ Common Restrictions on Awarded Land
Awarded lands โ€” especially CLOAs โ€” come with important rules:

๐Ÿšซ 10-Year No-Sell Rule โ€” CARP lands usually can't be sold or transferred for 10 years. Exceptions include passing it down through inheritance, giving it back to the government, or transferring to another qualified farmer-beneficiary.

๐Ÿšซ No Splitting Below Legal Limit โ€” in some cases, the land can't be divided into pieces smaller than what the law allows.

Huwag mag-assume na pareho lang lahat. Know the type of title of the land being offered to you.
