Atty., paano po kung nag affidavit of desistance na ang complainant, automatic ba madidismiss ang kaso?

Hindi po. Kahit pa mag motion to withdraw ang prosecutor, naka depende pa rin sa korte ang desisyon kung itutuloy ang kaso or hindi na. Isang grave abuse of discretion daw ayon sa Korte Suprema kung basta na lang pagbibigyan ng korte ang motion to withdraw Informarion ng prosecutor. (Summerville Gen. SC Champions FILSCAP’s Rights over Copyrighted Works |

Championing the intellectual property rights of those in the music industry, the Supreme Court has granted the petition of the Filipino Society of Composers, Authors and Publishers, Inc. (FILSCAP) to reverse and set aside the rulings denying its right to collect license fees and/or royalties over copyrighted works of its member artists.

In a Decision penned by Associate Justice Rodil V. Zalameda, the Court En Banc ordered respondent Anrey, Inc. to pay FILSCAP ₱10,000.00 as temperate damages for the unlicensed public performance of the copyrighted songs on FILSCAP’s repertoire and ₱50,000.00 as attorney’s fees, plus interest at the rate of 12% per annum from September 8, 2009 until June 30, 2013, and thereafter, 6% per annum from July 1, 2013 until finality of the Court’s judgment. Such amount shall be subject to interest at the rate of 6% per annum reckoned from the date of finality of this judgment until fully satisfied.

The Court held that playing radio broadcasts containing copyrighted music through loudspeakers (radio-over-loudspeakers) is a performance. Restaurants that play radio broadcasts over their speakers to enhance profit by providing entertainment to the public, particularly to their customers who pay for the dining experience, do not constitute fair use.

Ang sagot po ay, meron siyang kaso.

Sa pagkakasangkot nya sa pagplano sa pagsasagawa ng krimen, siya ay maituturing na "conspirator." Kapag may conspiracy, ang kasalanan o krimen ng isa ay krimen ng lahat. (People v. Manzanilla, G.R. No. 235787, 8 June 2020). Kung ano ang magiging parusa sa gumawa mismo ng pagpatay, ganon din ang parusa sa mga kasabwat nya o co-conspirators. Ibig sabihin, kung mapaparusahan sa kasong murder ang mismong pumatay, murder din ang kaso nung kasama sa pagplano ng krimen.

Ano mangyayari kung ang naka bangga ay namatay at yung nabangga ay hindi nagreport?

Ang aking sagot po ay kailangang maibestigahan pa rin kung sino talaga sa kanila ang may kasalanan (fault) or nagkulang (negligence) dahil hindi sa lahat ng pagkakataon ang nakabangga ay ang may kasalanan o nagkulang.

May ibang nagsasabi na dahil sa hindi nya pag report ng pangyayari, maaaring masampahan siya ng paglabag sa tinatawag na obstruction of justice; or, abandonment of a person whom he has injured; or, reckless imprudence resulting in homicide pa rin.

Pero, sa tingin ko, since he is involved, he could be a primary suspect. As such, he may even refuse to answer any question relative to the crime without the assistance of a counsel, more so volunteer the information to authorities.

Another thing, wala akong alam na krimen na hindi pag sumbong, maliban na sa Misprision of Treason, Article 116, RPC.

So, ulitin ko po, ang maaaring sagot muna sa ngayon ay, kailangan pa ring maibestigahan ang pangyayari. ⚖️
