Our firm is pleased to share an official communication from the Supreme Court's Office of the Court Administrator (OCA) regarding the Amended 2024 Rules on Notarial Practice.

In response to a query submitted by our firm notary public, Atty. Harold R. Sator, the OCA has clarified that for the purpose of monthly electronic submissions, only instruments acknowledged before a notary public are required to be transmitted to the Clerk of Court.

This explicitly excludes documents containing a jurat, such as Affidavits and Judicial Affidavits.

We hope this provides valuable guidance to our fellow legal practitioners and the general public in navigating the new requirements.

Magkano ang tubos sa lupa na matagal nang nakasangla?

Sagot. - Kung magkano ang sangla, ganon din dapat ang halaga ng tubos, plus interest na napagkasunduan. Kung magkano naman ang kailangang bayarang interest ay nakadepende yan sa nakasulat sa kasunduan.

Karaniwan, ang interest rate ay inilalagay sa kasunduan. Kung walang nakalagay kung magkano, ang interest rate ay ipinapantay sa Legal Rate of Interest, na ngayon ay nasa 6% per year. Mayroon ding kasunduan na ang paggamit sa lupa bilang tirahan, halimbawa, ay iyon na rin ang ibinibilang na kabayaran sa interest. Ganon din, maaaring ang magiging bunga or produkto ng lupa ay iyon na rin mismo ang kabayaran sa interest, katulad ng Contract of Antichresis. Ito ang nakasulat sa ating batas:

Article 2132. By the contract of antichresis the creditor acquires the right to receive the fruits of an immovable of his debtor, with the obligation to apply them to the payment of the interest, if owing, and thereafter to the principal of his credit.

Kaya, importante na basahin kung ano ang nakasulat sa kontrata upang matiyak kung magkano ba talaga ang kailangang bayaran.

Ang isa pang kontrobersyal na provision ng R.A. No. 9344 o ang Juvenile Justice and Welfare Act na hindi masyadong pinapansin, maliban sa pagiging Exempt sa Criminal Liability ng isang 15 years old.

Ito ang Sec. 39, ukol sa Discharge ng isang CONVICTED na bata kahit gaano pa kalagim ang kanyang ginawang krimen.
