First of all, you have to know whether you have the legal grounds to file the Petition for Annulment of Marriage or Nullity of your Marriage.

For Annulment of Voidable Marriages, your grounds could either be any of those mentioned under Article 45 of the Family Code.

For the declaration of nullity of marriage, your grounds could either be any of those mentioned under Article 35 (Absence of Formal and Essential Requisites of Marriage) Article 36 (Psychological Incapacity) Article 37 (Incestuous Marriages), and Article 38 (Marriages that are Void because of Public Policy).
