In a classic case of parent vs. grandparent, the Supreme Court upheld the right of the father to exercise parental authority and custody over the minor children. Citing Article 212 and 214 of the Family Code, the Court affirmed that it is only upon the parents' death, absence or unsuitability may substitute parental authority be exercised by the grandparents.

CAN GRANDPARENTS WREST CUSTODY OF MINOR CHILDREN FROM THEIR PARENTS? What if one of the parents is dead or absent? In Santos vs. CA, G.R. No. 113054 March 16, 1995, the Court held that "[t]he law vests on the father and mother joint parental authority over the persons of their common children. In case of absence or death of either parent, the parent present shall continue exercising parental authority. Only in case of the parents' death, absence or unsuitability may substitute parental authority be exercised by the surviving grandparent." Read more below.
