Sa real estate, malinaw ang prinsipyo: ang titulo ang tunay na ebidensya ng ownership.

Ayon sa batas at sa mga desisyon ng Korte Suprema ng Pilipinas, ang pagmamay-ari ng lupa ay pinatutunayan ng Transfer Certificate of Title (TCT) o Original Certificate of Title (OCT) na nakarehistro sa Registry of Deeds.

✔ Resibo, kasulatan, o Tax Declaration — hindi sapat para patunayan ang legal ownership.
✔ Ang rehistradong titulo ang nagbibigay ng proteksyon at karapatan sa may-ari.
✔ Ownership becomes enforceable only upon proper registration.

Sa pagbili ng property, verify the title, not just the story.

Maraming nalilito dito kaya klaruhin natin: ang Tax Declaration ay patunay lang na ikaw ang nagbabayad ng buwis sa isang property — hindi ito patunay ng ownership.

Sa batas at sa mga desisyon ng Korte Suprema ng Pilipinas, ang tunay na ebidensya ng pagmamay-ari ng lupa ay ang Transfer Certificate of Title (TCT) o Original Certificate of Title (OCT) na nakarehistro sa Registry of Deeds.

Ibig sabihin:
✔ Pwede kang may Tax Declaration pero hindi ikaw ang legal owner.
✔ Ang pagbabayad ng buwis ay indikasyon lang ng possession o paggamit.
✔ Ownership = titulo na nakapangalan at rehistrado.

Sa real estate, dokumento ang basehan, hindi claim.
Maging maingat, mag-verify, at laging due diligence muna bago bayad.

The Professional Regulatory Commission (PRC) requires an Authority to Sell (ATS) to protect property owners and real estate agents, and to ensure legal compliance.

Legal compliance: The Civil Code of the Philippines states that a sale of land or interest in land must be authorized in writing.

Real estate agents who sell property without an ATS may face administrative sanctions, such as suspension or revocation of their license.
Buyers who purchase property from an unauthorized agent may face an unenforceable contract.
