📌 SC Acquits Two in Drug Case Due to Chain of Custody Lapses

The Supreme Court has acquitted Joseph Atanacio and Jon Magno, who were earlier convicted for drug charges, after finding serious lapses in the handling of the seized items.

🔹 The Court said the police failed to immediately mark and inventory the drugs upon confiscation, as required by law.
🔹 Insulating witnesses only arrived 10 minutes after the arrest, creating doubt on the integrity of the evidence.
🔹 The forensic chemist also failed to explain how the drug specimens were handled before and after testing.

⚖️ The SC ruled that these lapses cast serious doubt on the evidence, leading to the immediate release of the accused.

👉 This decision serves as a reminder that in drug cases, strict compliance with the chain of custody rule is necessary to protect rights and uphold justice.

📣 Upholds Valid Suspension of Engineer Over Software Dispute ⚖️💻

In a recent ruling, the Supreme Court affirmed the legality of JGC Philippines, Inc.’s decision to place one of its senior engineers under preventive suspension after he blocked access to software he developed while employed in the company.

🧑‍💻 Engineer Santiago dJ. Sillano created several programs during his time with JGC. But when a dispute over software ownership erupted—Sillano claiming it was his, and JGC asserting company ownership—he activated security features that rendered the programs unusable.

🚫 JGC suspended Sillano and later dismissed him for refusing to unlock the software and surrender the source codes. Sillano retaliated with a case for illegal dismissal, while separately seeking software ownership recognition from the Intellectual Property Office (IPO), which ruled in his favor.

📌 While the Supreme Court upheld that preventive suspension was valid, it also ruled that JGC’s termination of Sillano was done without substantial due process—a violation of his rights under the Labor Code.

💡 Key takeaway: Employers may suspend employees up to 30 days without pay if they pose a threat to the company’s property or operations—but any dismissal must strictly follow due process.

Scammers are now using legit brand names and pretending to be official sellers to trick people online. They’ll lure you in with promos, discounts, or even fake receipts—but don’t be fooled!

Never do transactions through Messenger alone.
No matter how convincing the page looks, if the seller refuses to use secure, buyer-friendly platforms (like Shopee, Lazada, or trusted payment gateways), it's a red flag.

Protect yourself:

Always double-check the page’s legitimacy.

Look for reviews and verified badges.

Use secure platforms that offer buyer protection.

When in doubt, don’t send money.

Stay smart. Stay safe. Don’t let scammers win!

🚨 SCAM ALERT! 🚨

Beware of online scammers using Messenger to trick people into fake transactions! 😡💻📱

A scammer recently pretended to sell an item and asked for payment via GCash, bank transfer, or other digital wallets. After receiving the payment, they blocked the buyer and disappeared! 🚫💸

To protect yourself from online scams:
✅ Verify the seller’s identity before sending money.
✅ Check reviews or ask for proof of legitimacy.
✅ Avoid too-good-to-be-true deals—if it’s too cheap, it’s likely a scam!
✅ Use secure payment methods that offer buyer protection.
✅ Report and block suspicious accounts immediately!

The has dismissed from service a Regional Trial Court (RTC) clerk for soliciting and receiving money from a litigant’s parent in exchange for finding them a Public Attorney’s Office (PAO) lawyer.
In a Resolution, the Court En Banc found Gerald Eric F. Sanchez, Clerk III of the RTC, Cabuyao City, Laguna, guilty of gross misconduct and ordered his dismissal from service. The Court also ordered that Sanchez be perpetually disqualified from holding any position in government.
A complaint was filed against Sanchez for allegedly promising to help an accused in a criminal case in exchange for PHP 100,000. Additionally, a trial court judge requested Sanchez be investigated following reports that he had been acting as a “fixer,” soliciting money from litigants in exchange for securing PAO representation and expediting the resolution of their cases.
The Supreme Court ruled that despite his denials, Sanchez had indeed accepted money for personal gain. It cited Canon IV, Section 5 of the Code of Conduct for Court Personnel, which states that “[c]ourt personnel shall not recommend private attorneys to litigants, prospective litigants, or anyone dealing with the Judiciary.”
Furthermore, as Clerk III, Sanchez was not authorized to collect or receive money from any litigant. However, he asked and accepted PHP 50,000 in cash from the litigant and had an additional PHP 50,000 deposited into his mother’s account.
