Differences: Absolute Community of Property and Conjugal Partnership of Gains

People often confuse the terms absolute community and conjugal partnership relative to the property relations in marriages. Some even know only the more popular of the two in conjugal partnership. However, there are numerous distinctions between the two which drastically affect the properties which spouses either own in common or exclusively.

As to their technical meanings, absolute community of property comprises all the properties owned by the contracting parties before the marriage ceremony and those which they may acquire thereafter. The spouses become co-owners of all the properties in an absolute community of property regime. On the other hand, conjugal partnership of gains is wherein the spouses place in a common fund the fruits of their separate properties and income from their work or industry.

Illustrations of the two property regimes would be:
1. Absolute Community: Any property purchased by a husband prior to a marriage will also be owned by his wife upon marriage. The same goes with the properties of the wife acquire when she is still single which will then be co-owned by the husband at the moment of marriage.
2. Conjugal Partnership: Any property purchased or acquired by any of the spouses prior to a marriage will belong exclusively to his/her. However, at marriage, the properties of the spouses are joined together in a single regime and the proceeds, products, fruits and income from their separate properties and those acquired by either or both spouses through their efforts or chance.

It is worthy of note that when the spouses do not agree upon any specific property regime before they are married, under the Family Code the default or automatic property regime that they will be subjected to is the Absolute Community of Property.

Another important thing under absolute community are the properties which are excluded therefrom. Under Article 92 of the Family Code, such exclusions are:
1. Property acquired during the marriage by gratuitous title by either spouse, and the fruits as well as the income thereof, if any, unless it is expressly provided by the donor, testator or grantor that they shall form part of the community property;
2. Property for personal and exclusive use of either spouse. However, jewelry shall form part of the community property;
3. Property acquired before the marriage by either spouse who has legitimate descendants by a former marriage, and the fruits as well as the income, if any, of such property.

With respect to conjugal partnership of gains, Article 109 of the Family Code makes an enumeration on the properties which exclusively belong to each of the spouse:
1. That which is brought to the marriage as his or her own;
2. That which each acquires during the marriage by gratuitous title;
3. That which is acquired by right of redemption, by barter or by exchange with property belonging to only one of the spouses; and
4. That which is purchased with exclusive money of the wife or of the husband.

The use of alphanumeric dates in your checks will cease to be valid after April 30, 2023 (04-30-2023).

After that date, checks with full NUMERIC date format such as (MM-DD-YYYY) (month-day-year) will be the only valid format.

What does that mean for non-banking entities who received PDCs with alphanumeric date formats? It will not be cleared. So, inform your debtors/clients/customers to change their PDCs with full numeric dates for May 1, 2023 (05-01-2023) and onwards to avoid inconvenience.

DON’T SIGN ANYTHING YOU DON’T UNDERSTAND.

This appears to be a no-brainer but some people still get into trouble because of the documents they sign. From employment contracts, non-disclosure agreements (NDA), co-maker agreement, quitclaim, deed of donation, to other binding contracts, people sign documents because they solely rely on what others tell them are the contents of document they are signing. The problem is that sometimes, some tricksters deceive unsuspecting people. Worse, some don't fully understand what they are asking people to sign. To make sure this does not happen, it is always best to read the document and ask experts for advice if you don't understand the contents.

Madaling sabihin ito pero marami pa ring ibang tao na napapasubo dahil sa mga dokumentong nilalagdaan nila. Mapa-kontrata sa trabaho, NDA, kontratang pang-co-maker, quitclaim, deed of donation, at iba pang kontrata, lumalagda ang mga tao dahil nagdedepende sila sa sinasabi ng iba na diumano'y laman ng nasabing dokumento na kanilang nilalagdaan. Ang problema ay minsan, may mga manloloko na nanlilinlang ng mga walang kamalay-malay na tao. Ang mas masaklap pa, kahit ang mga nagpapalagda sa ibang tao ay hindi naiintindihan ang laman ng pinapapirma nila. Para maiwasan ito, mas maigi pa rin na basahin ang dokumento at magtanong sa elsperto kung hindi naiintindihan ang laman nito.

⚖️ 𝗗𝗔𝗜𝗟𝗬 𝗗𝗢𝗦𝗘 𝗢𝗙 𝗟𝗔𝗪 | 𝗖𝗮𝗻 𝗮 𝗽𝗿𝗶𝘃𝗮𝘁𝗲 𝘀𝗰𝗵𝗼𝗼𝗹 𝘄𝗶𝘁𝗵𝗵𝗼𝗹𝗱 𝘁𝗵𝗲 𝗰𝗵𝗶𝗹𝗱'𝘀 𝗰𝗿𝗲𝗱𝗲𝗻𝘁𝗶𝗮𝗹𝘀 𝗱𝘂𝗲 𝘁𝗼 𝗻𝗼𝗻-𝗽𝗮𝘆𝗺𝗲𝗻𝘁 𝗼𝗳 𝘀𝗰𝗵𝗼𝗼𝗹 𝗼𝗯𝗹𝗶𝗴𝗮𝘁𝗶𝗼𝗻𝘀?

Yes. Section 128 of Department of Education Order 88, Series of 2010 or the 2010 Revised Manual of Regulations for Private Schools in Basic Education expressly authorized private schools to withhold their students’ credentials due to non-payment of school obligations if the student will transfer to a public school.

“Section 128. Withholding of Credentials. The release of the transfer credentials of any pupil or student may be withheld for reasons of suspension, expulsion or nonpayment of financial obligations or property responsibility of the pupil or student to the school. The credentials shall be released as soon as his obligation shall have been settled or the penalty of suspension or expulsion lifted. ###”

Thus, it is apparent that the said order from the DepEd lawfully authorizes private schools to withhold their students' credential for the reason of nonpayment of financial obligations to the school. However, the student may temporarily be enrolled in a public school as per Department of Education Order 03, Series of 2018 or the “Basic Education Enrollment Policy” until the submission of required documents on or before August 31st of the current school year in which the parent/guardian should submit and sign an Affidavit of Undertaking.

Maaari bang pigilin ng isang pribadong paaralan ang mga kredensyal ng isang bata dahil sa hindi pagbabayad ng mga obligasyon sa paaralan?

Oo. Ang Section 128 ng Department of Education Order 88, Series of 2010 o ang 2010 Revised Manual of Regulations for Private Schools in Basic Education ay malinaw na pinahintulutan ang mga pribadong paaralan na pigilin ang mga kredensyal ng kanilang mga mag-aaral dahil sa hindi pagbabayad ng mga obligasyon sa paaralan kung ang mag-aaral ay lilipat sa isang pampublikong paaralan.

“Seksyon 128. Pagpigil ng mga Kredensyal. Ang pagpapalabas ng mga kredensyal sa paglipat ng sinumang mag-aaral o mag-aaral ay maaaring pigilan para sa mga dahilan ng pagsuspinde, pagpapatalsik o hindi pagbabayad ng mga obligasyong pinansyal o pananagutan sa ari-arian ng mag-aaral o mag-aaral sa paaralan. Ang mga kredensyal ay dapat ilabas sa sandaling mabayaran ang kanyang obligasyon o maalis ang parusang suspensiyon o pagpapatalsik. ###”

Kaya naman, maliwanag na ang nasabing kautusan mula sa DepEd ay legal na nagpapahintulot sa mga pribadong paaralan na i-withhold ang kredensyal ng kanilang mga mag-aaral sa kadahilanang hindi pagbabayad ng mga obligasyong pinansyal sa paaralan. Gayunpaman, ang mag-aaral ay maaaring pansamantalang mag-enrol sa isang pampublikong paaralan ayon sa Kautusan ng Kagawaran ng Edukasyon 03, Serye ng 2018 o ang "Basic Education Enrollment Policy" hanggang sa pagsusumite ng mga kinakailangang dokumento sa o bago ang Agosto 31 ng kasalukuyang taon ng pasukan kung saan ang ang magulang/tagapag-alaga ay dapat magsumite at pumirma ng Affidavit of Undertaking.

“Seksyon 128. Pagpugong sa mga Kredensyal. Ang pagpagawas sa mga kredensyal sa pagbalhin sa bisan kinsa nga estudyante o estudyante mahimong pugngan tungod sa mga hinungdan sa pagsuspinde, pagpalagpot o dili pagbayad sa mga obligasyon sa pinansyal o responsibilidad sa kabtangan sa estudyante o estudyante sa eskuylahan. Ang mga kredensyal ipagawas sa diha nga ang iyang obligasyon masulbad na o ang silot sa pagkasuspinde o pagpalagpot gilibkas. ###”

Busa, dayag nga ang nasangpit nga kamanduan gikan sa DepEd subay sa balaod nga naghatag ug pagtugot sa mga pribadong eskwelahan nga i-withhold ang kredensyal sa ilang mga tinun-an tungod sa wala pagbayad sa pinansyal nga obligasyon sa tunghaan. Bisan pa, ang estudyante mahimong temporaryo nga ma-enrol sa usa ka publikong eskwelahan sumala sa Departamento sa Edukasyon Order 03, Series of 2018 o ang "Basic Education Enrollment Policy" hangtod sa pagsumite sa gikinahanglan nga mga dokumento sa o sa dili pa ang Agosto 31 sa kasamtangang tuig sa pagtungha diin ang ginikanan/guardian kinahanglang mosumite ug mopirma ug Affidavit of Undertaking.
