"Kailangan bang English ang kontrata para maging valid?" 📝

Hindi.

Maaaring isulat ang kontrata sa wikang Filipino, English o sa anumang wikang parehong nauunawaan ng mga partido. Sa batas, hindi ang wikang ginamit ang nagbibigay ng bisa sa kasunduan kundi ang pagkakaroon ng kusang-loob na pahintulot at pagsunod sa mga rekisito ng batas.

Para sa mga MSMEs, ang paggamit ng wikang madaling maintindihan ay nakatutulong upang:

✅ Maiwasan ang hindi pagkakaunawaan;
✅ Maging malinaw ang mga karapatan at obligasyon ng bawat panig; at
✅ Mas maprotektahan ang inyong negosyo.

Ever wondered bakit parang “English mode” lagi sa korte?

Short answer: sa Philippine courts, English pa rin ang main language for pleadings, court records, decisions, and most formal legal documents. So kung may motion, petition, order, or decision, madalas English talaga ang default.

Pero wait—Filipino is official too!
• English ang working language. Ito ang karaniwang gamit sa written pleadings, official records, judicial decisions, and formal court processes.
• Filipino has constitutional status. Under the Constitution, both English and Filipino are official languages, kaya may legal basis ang paggamit ng Filipino in appropriate settings.
• Translation matters. Kapag ang document or evidence ay nasa ibang language, kailangan itong maintindihan ng court—usually through translation into English or Filipino.

Sa hearings, mas flexible ang usapan
• Witnesses can speak in the language they know. Kung mas comfortable ang witness sa Filipino, Tagalog, Bisaya, Ilocano, or another local language, puwede itong gamitin, with interpretation when needed.
• The accused must understand the proceedings. Hindi puwedeng puro legal English kung hindi naiintindihan ng accused. Importanteng alam niya kung ano ang nangyayari sa kaso.
• Access to justice ang goal. The more people understand court processes, the less intimidating the justice system becomes. Kaya language is not just grammar—it is access, fairness, and participation.
