TRAFFIC VIOLATION AND VEHICULAR ACCIDENT HACKS
By: Atty. J.R. Leonor

Traffic violations and vehicular accidents are really stressful added by the most common misconceptions that it will be costly due to penalties and fines and expensive charges of damages if found guilty, possibility of imprisonment etc., hence the tendency of the persons involved to immediately and by all means, escape, or deny being at fault, and even go to extents of getting aggressively defensive resulting to quarrels and altercations between parties and even to killings due to heat of anger.

We must avoid those misconceptions inorder not to aggravate matters and to avoid further liabilities. In case we figure in such situations of us being apprehended due to traffic violations, or us being involved in vehicular accidents, whether we are at fault or not we must remember that:

1. We must not run or escape;

2. We must be calm and must not panic;

3. In case of v. accidents, check ourselves and our passengers first if everybody's ok, inquire as well the other parties, then check the vehicles;

4. In case of v. accidents, as much as possible dont move the vehicles from the location or point of accident;

5. Call for help from proper authorities and emergency responders, or in case of apprehensions, comply with the requests of the apprehending officers such as the giving of driver's license, car registration, etc. And converse with them politely, and courteously inquire as to what your violation is or what is the reason for the apprehension;

6. Take pictures, names and other important details of parties and eye witnesses as well as their contact numbers, check for parties' driver's license and vehicle registration if still updated;

7. Have the incident blottered to the nearest brgy. Or police station;

8. In case of apprehensions, after complying with the officer's requests, explain yourself as to why you should not be held liable for the traffic violation, and ask if it's possible that you could be spared from the same, and if not spared, accept your violation and dont argue as it is pointless already to argue if the officer had made his mind up and finished preparing your ticket. After all maybe you're really at fault and you deserve that, YET THE FINES ARE JUST MINIMAL (commonly 200 Pesos for common traffic violations) and not as high as you thought of, same with the penalties in case of v. Accidents resulting in damage to property, in physical injuries or in homicide;

9. Also in apprehensions, don't forget to ask how much your fine is and as to how, when and where you will pay and reclaim your driver's license, and another taboo is, NEVER CORRUPT THE APPREHENDING OFFICER, AND REFUSE THE OFFICER WHO SOLICITS FOR BRIBE, instead, just ask for a ticket for the violation rather than committing a more serious crime of corruption of public officers;

10. Lastly in apprehensions, if you feel aggrieved on receiving a ticket, you can contest the same to the proper forums depending on who the apprehending agency is, or you may even bring the matter to court. Also, as I mentioned in case of the officer soliciting for a bribe, that you instead ask that you'll be given a ticket, or for any untoward demeanor or unjust and unlawful apprehension committed by the officer, you can report the said officer to the proper authorities or to his concerned agency for after all, his details are contained in the ticket;

11. Lastly in v. Accidents, as much as possible parties should amicably settle the dispute. Avoid arguing with each other as to who is at fault and who is not, for normally each party will deny being at fault and point the other party to be at fault. It is pointless that parties will argue there and then because it is not a proper forum where there could be rendering of resolution, worse you'll just end up quarreling with each other. Instead, avoid arguing, and if things get heated, secure and make sure to get all the details abovementioned in the prior numbers, and then leave. Talk to each other when things have cooled down and try again to amicably settle matters relating to the accident so as to avoid lengthy and costly litigations, or in case of negotiation deadlock have the matter mediated by competent authorities, and if still unresolved consult lawyers and have them represent you first in an off-court settlement or alternative dispute resolution and finally, as a last recourse, to the courts;

12. Finally, see and consult a lawyer the soonest possible time in order to be informed and apprised with your rights and obligations basing on your current situation, and for the timely employment of legal remedial measures, and most importantly for your well-being and peace of mind.

In conclusion, we must not run or escape in times of apprehensions for traffic violations, or figuring in vehicular accidents. We must stay calm and relaxed during these times. We must not fear these occurrences as they normally happen, but we can avoid these occurrences if we ardently observe and comply with the traffic rules and regulations, and if we exercise the required deligence, such as the deligence of a good father, or extraordinary diligence if need be in driving our motor vehicles. If we are indeed at fault, we must face it and accept the corresponding consequences, and if not, we should still face it and put up our defense in the proper forum.

-For it is our decisions and our actions that brought us into where we are, hence we should blame nobody and personally face what will be.
