LEONEN TO CONGRESS: DON'T ACT AS IF YOU ARE A JUDGE OR PROSECUTOR IN CONDUCTING LEGISLATIVE INQUIRIES

Senior Associate Justice Marvic Leonen has reminded the Senate and House of Representatives not to act as a court and prosecutor in conducting inquiries in aid of legislation, emphasizing that the Congress has no power to determine the guilt of the resource persons being invited in the congressional investigation.

In his separate concurring opinion to the recent Supreme Court En Banc ruling that dismissed the petitions by pro-Duterte vloggers against the House of Representatives Tri-Committee, Leonen emphasized that Congress is neither a law enforcement nor a trial agency, and it's congressional investigation should be related to, and in furtherance of, a legitimate task of the Congress, which is to enact a law.
