HINDI PAGTANGGAP NG RESIGNATION, LEGAL BA?

An employer cannot “deny” your resignation in the sense of forcing you to remain employed. Resignation is an employee-initiated termination of the employment relationship, subject to the 30-day notice rule (or payment of damages if no notice), unless there is a lawful/contractual ground for immediate resignation.
Under the Labor Code, “An employee may terminate without just cause the employee-employer relationship by serving a written notice on the employer at least one (1) month in advance. The employer upon whom no such notice was served may hold the employee liable for damages.” [Art. 300 (a), LC renumbered]
What an employer may or may not do:
1. Employer cannot compel you to keep working if you resign (you can end the relationship by complying with the notice requirement, or by resigning for just cause).
2. Employer may insist on the 30-day notice (or claim damages) if you resign without just cause and without the one-month notice.
3. Employer “acceptance” matters mainly for effectivity/withdrawal issues, not to block resignation.
• If you already resigned and the employer accepted it, you generally cannot withdraw it unilaterally; whether to allow the withdrawal is the employer’s prerogative.
• A resignation intended to take effect on a later date may still require employer approval/acceptance for that intended effectivity in some contexts; where the employer’s acts show it did not accept the resignation, the separation may be treated as a dismissal if the employer terminates you instead.
Kaya, kung nag-notify ka naman 30 days prior to the effective date of your resignation, or following the # of days required under your employment contract, tapos ayaw kang payagan--BAWAL YAN!
