The Supreme Court has affirmed the conviction of an accused for robbery for demanding money from his ex-girlfriend in exchange for deleting her n**e photos posted on Facebook.

This was the ruling of the Supreme Court’s Second Division, in a Decision penned by Associate Justice Amy C. Lazaro-Javier, convicting Axel Tria (Tria) of robbery with violence against or intimidation of persons. He was sentenced to imprisonment for six to 14 years.

Tria was in a romantic relationship with AAA. When Tria became jealous, AAA gave him the password to her Facebook account to appease him. However, Tria threatened to upload their s*x video and photos online.

AAA tried to break up with Tria, but he took out his gun and showed her their s*x video and some of her pictures. Tria initially agreed to delete the files, but later demanded from Tria PHP 55,000.00. When AAA refused to pay, Tria hacked her business page and changed her username and password to prevent her from accessing the account.

A few days later, AAA’s sister saw half-naked photos of the latter on her page. The photo was a screenshot of the s*x video Tria showed AAA. Another photo of a naked woman with AAA’s face superimposed was also uploaded.

Tria demanded PHP 55,000 in exchange for deleting the photos, but AAA said she could only give him PHP 20,000. Tria’s continued demands led AAA to report the matter to the Criminal Investigation and Detection Group (CIDG) Anti-Cybercrime Group.

In an entrapment operation, the CIDG arrested Tria after he accepted money from AAA. Tria was then charged with robbery and online libel under two separate Informations.

The Regional Trial Court found Tria guilty of robbery, but acquitted him of online libel for lack of evidence. This was affirmed by the Court of Appeals.

The Supreme Court ruled that Tria’s conviction for robbery should be sustained.

The elements of robbery under Article 249(5) of the Revised Penal Code (RPC) are: (a) there is personal property belonging to another; (b) there is unlawful taking of that property; (c) the taking is with intent to gain; and (d) there is violence or intimidation.

In this case, AAA was clearly forced to part with her money in exchange for the deletion of her n**e photos posted on her page.

The taking was deemed complete the moment Tria gained possession of her money. Meanwhile, Tria’s intent to gain is presumed.

“Her compromising photos damaged and continued to damage her family life, reputation, and online business; thus, she felt she had no choice but to accede to Tria’s demands,” said the Court.

As the crime was committed with the use of communication technologies, the imposable penalty under the RPC is raised by one degree higher in accordance with Section 6 of Republic Act No. 10175, or the Cybercrime Prevention Act. (Courtesy of the Supreme Court Public Information Office)

SC Welcomes Signing Into Law of RA 11691

Chief Justice Alexander G. Gesmundo today welcomed the signing into law of Republic Act No. 11691, or the Judiciary Marshals Act, creating the Office of the Judiciary Marshals which will protect and safeguard the country‟s court system.

Under RA 11691 (An Act Creating the Office of the Judiciary Marshals, Defining its Powers, and Functions, and Appropriating Funds Therefor), the Office of the Judiciary Marshals shall be primarily responsible for the security, safety, and protection of the members, officials, personnel, and property of the Judiciary, including the integrity of the courts and its proceedings.

Chief Justice Gesmundo said that RA 11691 will be a great help not only to the Supreme Court but to the entire Judiciary as well in ensuring an efficient and effective delivery of justice.

“Indeed, the creation of RA 11691 will not only secure, protect, and safeguard the Judiciary but will also boost the morale of its members, officials, and personnel at this time when there is the concern of the threats to judges and killings of lawyers,” expressed the Chief Justice.

“As the Supreme Court En Banc expressed in a statement on March 23, 2021, „the Judiciary is one of the three pillars of our republican democracy, which itself hangs on a careful balance between and among governmental powers. To threaten our judges and our lawyers is no less than an assault on the Judiciary. To assault the Judiciary is to shake the very bedrock on which the rule of law stands,‟” added Chief Justice Gesmundo.

The Chief Justice, in a meeting with United States Embassy officials last February, said that he will seek the assistance of the United States Government in the operationalization of the Office of the Judiciary Marshals, especially in establishing a judiciary marshals academy.

The Supreme Court, during its En Banc deliberations today, April 26, 2022, denied with finality the motions for reconsideration of its December 7, 2021 decision on the petitions challenging Republic Act No. 11479 (R.A. 11479), or The Anti-Terrorism Act of 2020.

The Court resolved to deny the motions for reconsideration due to lack of substantial issues and arguments raised by the petitioners.

The Members of the Court maintained their votes in their December 7, 2021 Decision, which was penned by then Associate Justice and now Philippine Judicial Academy Chancellor Rosmari D. Carandang. Newly appointed Associate Justice Antonio T. Kho, Jr. sided with the majority.

An entry of judgment was immediately ordered by the Court.

The SC Public Information Office will upload in the SC website a copy of the Resolution denying the motions for reconsideration once available. # # #"

On 04 March 2022, President Duterte signed/approved Republic Act (RA) No. 11648 or an “Act Providing for Stronger Protection Against R**e and Sexual Exploitation and Abuse” which provides, among others, that R**E is committed by a person who shall have carnal knowledge of another person “when the offended party is under 16 years of age or is demented, even though none of the circumstances mentioned above be present.
