Eto ang nangyari at magdesisyon ka kung tama o mali:

🚨 CASE DIGEST: Tatlong beses na-terminate ang pagbubuntis sa IISANG doktor. Pwede bang mag-sue ang asawa for damages? ANG SAGOT: HINDI.

Geluz v. Court of Appeals
G.R. No. L-16439 | July 20, 1961

Eto ang kwento:
Noong 1950, bago pa ikasal si Nita Villanueva kay Oscar Lazo, nabuntis siya. Para itago ang pagbubuntis sa kanyang mga magulang, pumunta siya kay Dr. Antonio Geluz para i-terminate ang pregnancy. Pagkatapos nilang magpakasal, nabuntis ulit si Nita. Dahil empleyado siya ng Commission on Elections at naging sagabal ang pagbubuntis, bumalik siya kay Geluz para sa pangalawang procedure noong October 1953.

Wala pang dalawang taon β€” nabuntis na naman siya. Noong February 21, 1955, pumunta si Nita sa clinic ni Geluz at nagpa-procedure ng two-month old pregnancy para sa halagang P50. Hindi alam ni Lazo at wala siyang pahintulot.

Nag-sue si Lazo kay Dr. Geluz for damages base sa pangatlong procedure.

Ang trial court? Pinagbayad si Geluz ng P3,000 damages + P700 attorney's fees. Ang CA? Kinumpirma.

Si Alastair John Kane at Patricia Roggenkamp β€” pareho silang Australian citizens na nag-live in dito sa Pilipinas. Mag-jowa sila. Pumunta sila sa birthday party ng anak ni Patricia noong November 30, 2004. Pagkauwi β€” nagkasagutan.

Ayon kay Patricia, pinulot siya ni Alastair mula sa upuan, binagsak sa sahig, sinuntok sa ulo, kinaladkad sa buhok papunta sa k**a, at itinulak ang mukha niya sa unan.

Supreme Transportation Liner v. San Andres

Eto ang nangyari:
Alas singko ng umaga, isang Mabel Tours Bus ang umovertake sa isang Toyota Revo sa Maharlika Highway. Nag-sideswiped, nawala sa kontrol, at nag-swerve sa kabila β€” HEAD-ON COLLISION sa Supreme Bus na galing sa kabilang direksyon. Hindi pa tapos. Yung Mabel Tours Bus tuloy-tuloy pa rin ang andar β€” nabangga pa ang isang nakaparadang jeepney na nahulog sa kanal. Apat na sasakyan ang nasira. Buti na lang, walang namatay.

Ngayon, eto ang nakakaloka:
Si San Andres β€” yung may-ari ng Mabel Tours Bus na NAGDULOT ng aksidente β€” siya pa ang nag-file ng civil case for damages LABAN sa Supreme Transportation. Sinabi niyang P144,500 daw ang pinsala sa bus niya at P150,000 ang unrealized profits.

🚨 CASE DIGEST: Can you delay a criminal case just because there's a pending civil case?
Consing v. People | G.R. No. 161075 | July 15, 2013
Here's what happened:
Consing and his mother took out P18 MILLION in loans from Unicapital using a real estate mortgage on a property in Cavite. Unicapital even purchased half the property for P21.2 million. But when they went to develop the land β€” the title was FAKE. The real owners were completely different people.
Unicapital demanded P41 million back. Consing? He ignored the demand letters. So Unicapital filed a criminal case for estafa through falsification AND a civil case for damages.
Consing's defense strategy: Suspend the criminal case because there's a "prejudicial question" β€” the court needs to determine first whether he was just an agent of his mother.
WHAT DID THE SUPREME COURT SAY?
❌ DENIED.
A civil action for fraud under Article 33 of the Civil Code is an INDEPENDENT civil action. It cannot be used to suspend a criminal case. The result of the civil case is completely irrelevant to whether the accused is guilty of estafa.
And even if he was just his mother's agent? He can STILL be held liable for conspiracy to falsify public documents.
