LEONEN WARNS: ABSOLUTE APPLICATION OF 'FUGITIVE DISENTITLEMENT DOCTRINE' COULD WORSEN SOCIETAL INEQUALITIES

Supreme Court Senior Associate Justice Marvic Leonen warned that completely prohibiting fugitives from seeking court relief could only worsen existing inequalities and injustices in society, emphasizing that some accused only evade arrest not out of defiance, but due to fear for their personal safety or concerns over political persecution.

In his concurring and dissenting opinion to a recent Supreme Court En Banc ruling, Leonen noted the need to be extra careful in applying the newly adopted fugitive disentitlement doctrine, as the absolute application of the doctrine could be abused for political or purely personal agendas.
