NOISE CAN BE A NUISANCE ANY TIME, IF UNREASONABLE

The Civil Code defines a nuisance to include anything that “annoys or offends the senses” or “injures or endangers the health or safety of others.”

In noise cases, the Supreme Court recognizes that noise is not automatically illegal, but it becomes a nuisance when it injuriously affects the health/comfort of ordinary people to an unreasonable extent, considering the locality and surroundings. (Frabelle vs. AC Enterprises, 888 Phil. 950 (Nov. 2020)

Because the governing rule is unreasonableness/excessiveness, not a fixed “10:00 PM” threshold, therefore a person may still be liable for loud noise even before 10:00 PM if the noise is excessive or unreasonably injures/annoys others under the circumstances.
