If either husband or wife has a paramour (kabit) or is engaging in an extramarital affair, there are both criminal and civil remedies available under Philippine law โ€” depending on who is the offending spouse and the circumstances.

Criminal case:

For the WIFE
A. Adultery (Article 333, Revised Penal Code)
โ€ข Filed against: The wife and her paramour (the man she is having sexual relations with).
โ€ข Elements:
1. The woman is married.
2. She has sexual in*******se with a man not her husband.
3. The man knew she was married.
โ€ข Who can file: Only the offended husband, and he must include both his wife and her paramour in the complaint.
โ€ข Penalty: Prisiรณn correccional (6 months and 1 day to 6 years imprisonment).

For the HUSBAND:
B. Concubinage (Article 334, Revised Penal Code)
โ€ข Filed against: The husband and his mistress (kabit).
โ€ข Elements:
1. The husband keeps a mistress in the conjugal dwelling; or
2. Has sexual in*******se under scandalous circumstances with a woman not his wife; or
3. Cohabits with her in any other place.
โ€ข Who can file: Only the offended wife, and she must include both her husband and his concubine.
โ€ข Penalty: Prisiรณn correccional (same range) for the husband; destierro (banishment) for the concubine.

Grounds for Cyberlibel are governed primarily by Article 353 in relation to Articles 354โ€“355 of the Revised Penal Code (RPC), as amended by Republic Act No. 10175 (Cybercrime Prevention Act of 2012).

โš–๏ธ 1. Definition (Article 353, RPC)

โ€œLibel is a public and malicious imputation of a crime, or of a vice or defect, real or imaginary, or any act, omission, condition, status, or circumstance tending to cause dishonor, discredit, or contempt of a natural or juridical personโ€ฆโ€

When this is committed through a computer system or any online platform, it becomes Cyberlibel under Section 4(c)(4) of R.A. 10175.

๐Ÿงพ 2. Essential Elements of Cyberlibel

To constitute cyberlibel, all the following must be present:
1. Imputation of a discreditable act or condition โ€” something that tarnishes the reputation of a person (e.g., calling someone corrupt, adulterer, scammer, etc.);
2. Publication โ€” the defamatory statement is made public or shared with a third person (posting online, tagging, sharing, commenting, etc.);
3. Identifiability โ€” the offended party is identifiable, even if not named explicitly;
4. Malice โ€” there is intent to malign or harm the personโ€™s reputation (presumed in libel unless good motives and justifiable ends are proven);
5. Use of a computer system โ€” committed through online means (Facebook, X/Twitter, Instagram, blogs, email, etc.).

๐Ÿ’ป 3. What Makes It Cyberlibel (R.A. 10175)

Section 4(c)(4) of the Cybercrime Law specifically penalizes:

โ€œLibel as defined in Article 355 of the Revised Penal Code committed through a computer system or any other similar means which may be devised in the future.โ€

In short:
๐Ÿ—ž Libel (in print) โ†’ punishable under Art. 355
๐Ÿ’ป Libel (online) โ†’ punishable under Sec. 4(c)(4) of R.A. 10175

๐Ÿšซ 4. Defenses Against Cyberlibel
โ€ข Truth (if published with good motives and for justifiable ends)
โ€ข Privileged communication (e.g., fair comment on public interest)
โ€ข Lack of malice
โ€ข No publication (if only privately messaged)
โ€ข Lack of identifiability (cannot tell who the subject is)

โ€ข Under R.A. 10175, cyberlibel carries a penalty one degree higher than ordinary libel:
โ€ข Prisiรณn correccional in its maximum period to prisiรณn mayor in its minimum period (up to 8 years imprisonment
