A glimpse into the Young Lawyers Association of Cebu, Inc.’s (YLAC) Orientation and Presentation of Nominees where new recruits are formally charged as such.

Membership in YLAC is not open to all. Entry is by invitation, but even that is never enough. Each recruit undergoes a rigorous screening process, where only a select few are allowed to move forward. From more than thirty (30) invitees, only ten (10) earned the privilege of being charged.

This moment is both recognition and responsibility. Passing the screening is only the beginning. The real test lies ahead. It reflects YLAC’s continued commitment to uphold a standard defined by competence, integrity, and credibility.

YLAC also commends its Membership Committee, led by Chairman Atty. Jo Kristian Borbajo, with Assistant Chairmen Atty. John Henry Seno and Atty. Keneth Jorge Esparagoza, for ensuring that this standard is not only maintained, but consistently enforced.

In the digital age, a "confidential" document can go viral in minutes. But beyond the headlines, 𝑤ℎ𝑎𝑡 𝑑𝑜𝑒𝑠 𝑡ℎ𝑒 𝑙𝑎𝑤 𝑎𝑐𝑡𝑢𝑎𝑙𝑙𝑦 𝑠𝑎𝑦 𝑤ℎ𝑒𝑛 𝑠𝑒𝑛𝑠𝑖𝑡𝑖𝑣𝑒 𝑝𝑢𝑏𝑙𝑖𝑐 𝑠𝑒𝑐𝑡𝑜𝑟 𝑖𝑛𝑓𝑜𝑟𝑚𝑎𝑡𝑖𝑜𝑛 𝑖𝑠 𝑏𝑟𝑒𝑎𝑐ℎ𝑒𝑑?

Whether it was an intentional "leak" or a result of negligence, the legal consequences in 2026 are more stringent than ever.

1️⃣ 𝐀𝐝𝐦𝐢𝐧𝐢𝐬𝐭𝐫𝐚𝐭𝐢𝐯𝐞 𝐋𝐢𝐚𝐛𝐢𝐥𝐢𝐭𝐲
Under the 2025 Rules on Administrative Cases in the Civil Service (2025 RACCS), a public officer doesn't need "malicious intent" to be held liable. The charges could include unauthorized disclosure, which can be classified as Grave Misconduct or Conduct Prejudicial to the Best Interest of the Service.

Even the mere mishandling of records, such as failing to follow reasonable office rules for filing or storage, can expose an employee to disciplinary action or dismissal.

2️⃣ 𝐂𝐫𝐢𝐦𝐢𝐧𝐚𝐥 𝐂𝐨𝐧𝐬𝐞𝐪𝐮𝐞𝐧𝐜𝐞𝐬
A leak is not just an HR issue. It can be a crime. Depending on how the data was obtained, an officer may face charges under:

👉The Revised Penal Code: Specifically, Revelation of Secrets by a public officer.
👉Cybercrime Prevention Act: If the info was "hacked" or accessed through unauthorized computer-related means.
👉Anti-Graft and Corrupt Practices Act: For disclosing confidential information for personal gain.
👉Data Privacy Act: If the unauthorized processing or disclosure was made without a legal basis.

3️⃣ 𝐈𝐧𝐬𝐭𝐢𝐭𝐮𝐭𝐢𝐨𝐧𝐚𝐥 𝐑𝐞𝐬𝐩𝐨𝐧𝐬𝐢𝐛𝐢𝐥𝐢𝐭𝐲
Government agencies have a "Duty of Care." When a breach happens, the agency is scrutinized: Did they have firewalls? Did they train staff?

If the agency failed to implement "reasonable protection measures," it may face heavy regulatory penalties from the NPC.

🛡️ 𝑻𝙝𝒆 𝑩𝙤𝒕𝙩𝒐𝙢 𝙇𝒊𝙣𝒆
In the public sector, information is a form of power, but it is also a heavy responsibility. 𝙏𝙝𝙚 𝙡𝙖𝙬 𝙗𝙖𝙡𝙖𝙣𝙘𝙚𝙨 𝙩𝙝𝙚 𝙣𝙚𝙚𝙙 𝙛𝙤𝙧 𝙩𝙧𝙖𝙣𝙨𝙥𝙖𝙧𝙚𝙣𝙘𝙮 𝙬𝙞𝙩𝙝 𝙩𝙝𝙚 𝙖𝙗𝙨𝙤𝙡𝙪𝙩𝙚 𝙙𝙪𝙩𝙮 𝙩𝙤 𝙥𝙧𝙤𝙩𝙚𝙘𝙩 𝙨𝙚𝙣𝙨𝙞𝙩𝙞𝙫𝙚 𝙙𝙖𝙩𝙖.

Safeguarding information is not just a technical task. Rather, it is a core part of the public trust. When confidentiality is breached, the fallout is rarely just political. It is often legal, and it can be career-ending.

UNESCO is appalled by the attack on a school in Shukeiri, Sudan, where a drone strike reportedly killed schoolgirls and teachers. Educational institutions are protected spaces under international humanitarian law. They should never be targeted, attacked, or repurposed for military use. In accordance with its mandate and with United Nations Security Council Resolution 2601 (2021), recalls the obligations of all parties to protect schools, students, and education personnel.

“Alam mo ang laging sinasabi ng Presidente sa akin: Matulungan yung mga nangangailangan, pero huwag na natin silang [papabalik-balikin] at pahirapan,” saad ng kalihim.

Sisimulan sa Martes, Marso 17, ang cash aid distribution sa 39 payout sites sa buong Metro Manila, kung saan uunahin ang nasa 139,000 na tricycle drivers at susundan ng iba pang PUV drivers, kabilang na ang jeepney, taxi, bus, at transport network vehicle service (TNVS) drivers.

The Judiciary adopts flexible work arrangements and energy conservation measures starting March 9, 2026 in Memorandum Circular No. 02 - 2026 issued by Chief Justice Alexander G. Gesmundo.

In the Memo, the (SC) observes a four-day on-site and one-day work-from-home (WFH) work arrangement, citing Friday as the generally observed WFH day and provided that at least 25% of the employees in each office or division shall report on-site every Friday, as determined by the head of office or division, to ensure continuity of operations.

The Office of the Chief Justice, the Office of the Senior Associate Justice, the Offices of the Associate Justices, the Cash Collection and Disbursement Division of the Fiscal Management and Budget Office, the Docket-Receiving Section of the Judicial Records Office, the Management Information Systems Office (MISO) with respect to its essential staff, and the Office of the Judiciary Marshals are excluded from this work arrangement, and shall maintain the regular work arrangements.

The Court of Appeals (CA) shall observe the same work arrangements prescribed for the SC, provided that on Fridays, at least 25% of the employees in each office or division shall report on-site, and, at least, three Justices comprising one division, on a rotation basis, shall be available to act on urgent matters, including petitions for extraordinary writs and petitions and motions in connection with Republic Act No. 9160, or the Anti-Money Laundering Act, as amended.

Meanwhile, the Sandiganbayan and Court of Tax Appeals shall continue to observe a full five-day on-site workweek, without special work arrangement.

The First- and Second- Level Courts shall likewise observe a four-day on-site and one-day WFH arrangement.

In single-sala courts, Presiding Judges may adopt either of the following on-site work schedules: (1) on-site work from Monday to Thursday, with Friday designated as the WFH day, or (2) on-site work from Tuesday to Friday, with Monday designated as the WFH day; Provided that pairing courts shall not be on WFH schedule on the same day.

In multiple-sala courts, the four-day on-site and one-day WFH arrangement shall be implemented alternately. Within the same week, odd-numbered branches shall initially report on-site from Monday to Thursday, with Friday designated as the WFH day, while even-numbered branches shall report on-site from Tuesday to Friday, with Monday designated as the WFH day. In the following week, the schedules shall be reversed (i.e., the odd-numbered branches shall report on-site from Tuesday to Friday, with Monday as the WFH day, while the even-numbered branches shall report on-site from Monday to Thursday, with Friday as the WFH day.) This alternating schedule shall continue every week until the four-day workweek arrangement is lifted.

The flexible work arrangements prescribed in Memorandum Circular No. 02 - 2026 shall commence on March 9, 2026, and shall remain in force until modified or lifted by the SC.

In the modern legal area, this "Babaylan" wisdom is reflected in how our Supreme Court balances the scales of justice. Here are five pivotal rulings that define the current state of RA 9262 (Anti-VAWC Act).

👉 𝗕𝗿𝗲𝗮𝗸𝗶𝗻𝗴 𝘁𝗵𝗲 𝗕𝗮𝗿𝗿𝗶𝗲𝗿 𝗼𝗳 𝗘𝘅𝗽𝗲𝗿𝘁 𝗧𝗲𝘀𝘁𝗶𝗺𝗼𝗻𝘆
In ### v. People and AAA, G.R. No. 270257 (August 12, 2024), the Court held that a psychological or psychiatric evaluation is not indispensable to prove psychological violence. A victim’s credible testimony and the surrounding circumstances are sufficient to establish the mental anguish caused by an accused’s acts.

👉 𝗗𝗲𝗳𝗶𝗻𝗶𝗻𝗴 𝘁𝗵𝗲 𝗦𝗰𝗼𝗽𝗲 𝗼𝗳 𝗣𝘀𝘆𝗰𝗵𝗼𝗹𝗼𝗴𝗶𝗰𝗮𝗹 𝗩𝗶𝗼𝗹𝗲𝗻𝗰𝗲
In ### v. People of the Philippines, G.R. No. 250219 (March 1, 2023), the Court reiterated that acts like abandonment or marital infidelity constitute psychological violence when they result in proven emotional suffering. The law focuses on the effect of the abuse on the victim’s well-being.

👉 𝗟𝗮𝘄 𝗕𝗲𝘆𝗼𝗻𝗱 𝗚𝗲𝗻𝗱𝗲𝗿 𝗦𝘁𝗲𝗿𝗲𝗼𝘁𝘆𝗽𝗲𝘀
In Jacinto v. Fouts, G.R. No. 250627 (December 7, 2022), the Court emphasized that RA 9262 is determined by the act and its effects. The law’s protection is inclusive, clarifying that a woman can seek protection even in a le***an or same-sex relationship.

👉 𝗧𝗵𝗲 𝗦𝗵𝗶𝗲𝗹𝗱 𝗼𝗳 𝗗𝘂𝗲 𝗣𝗿𝗼𝗰𝗲𝘀𝘀 (𝗦𝘂𝗳𝗳𝗶𝗰𝗶𝗲𝗻𝗰𝘆 𝗼𝗳 𝗜𝗻𝗳𝗼𝗿𝗺𝗮𝘁𝗶𝗼𝗻)
In ### v. People of the Philippines, G.R. No. 260547 (November 26, 2024), the accused was acquitted because the Information failed to allege essential elements of psychological violence. This reminds us that even in VAWC cases, the constitutional right to be informed of the nature of an accusation is paramount.

👉 𝗧𝗵𝗲 𝗥𝗲𝗾𝘂𝗶𝗿𝗲𝗺𝗲𝗻𝘁 𝗼𝗳 "𝗠𝗲𝗻𝘀 𝗥𝗲𝗮"
In Acharon v. People of the Philippines, G.R. No. 224946 (November 9, 2021), the Court clarified that mere failure to provide support—absent proof of a specific intent to cause mental or emotional anguish—does not automatically result in criminal liability under Section 5(i).
